Recommendation for Approval of Meeting Agenda

- Speakers before the entire board are not allowed to use props, displays, or any other objects during the presentations. However, informational handouts may be given to the assistant secretary to the board for distribution prior to or following the meeting.
- Each speaker is allowed three minutes to address the board and may not share these minutes with any other speaker.
- At the end of 2-1/2 minutes, a bell will sound once. You will then have 30 seconds to finish your statement.
- At the end of three minutes, the bell will sound twice, indicating that your time is up.
- The superintendent will look into the speakers’ issues and, if necessary, represent the board in following up or recommend action to the board.

Recommendation to Receive a Report Regarding Board Policies to Implement Senate Bill 150; to Adopt Related Board Policies for First Reading; and to Receive for Review Related Administrative Procedures
On March 29, 2023, Senate Bill 150 became law. Sections 1 through 3 pertain to public schools and the Board is required to adopt policies to implement the provisions of the bill.
Several key aspects of the bill pertaining to the treatment of transgender students raise significant concerns for the District. Specifically, the District is concerned that SB 150 targets transgender students because of their non-conforming gender identity and may therefore be discriminatory on the basis of sex; may create barriers to access to equal educational opportunity; may limit the rights of parents/guardians; and may endanger the health, safety, and lives of hundreds of children in District schools.
The Board will receive two versions of the policies and administrative procedures. A side-by-side comparison of the differences between the versions will also be provided. Both versions were reviewed and discussed by the Board Policy Committee meeting on July 10, 2023. The committee reached a consensus to bring forward both versions for consideration by the Board.

Overview and Update on the Implementation Timeline for the Student Outcomes-Focused Governance Framework
The Council of the Great City Schools (CGCS) has developed a Student Outcomes-Focused Governance Framework to support large urban school districts to adopt school board behaviors and practices that create the conditions necessary to improve student outcomes.
Since earlier in 2023, the Board has been active with implementation of the Student Outcomes-Focused Governance Framework, with support from CGCS. During this Work Session, the Board will receive an overview and update on the Board’s Implementation Timeline from the CGCS Student Outcomes-Focused Governance Coach.

Update on Terminology Shifts in ESL for Inclusion
Our team will be presenting a proposal to shift the terminology we currently use in JCPS from ESL student to ML (multilingual learner). The purpose of this change is to focus on the strengths of multilingual learners and transition from a deficit-based approach to an asset-based approach.
This project directly supports strategy 1.1.3 in Vision 2020, Provide equitable access. Develop and improve systems and practices to recognize student strengths and to provide equitable access to engaging learning opportunities, supports and resources.

Recommendation for Approval of Bid for Walking Track at Greathouse/Shryock Traditional Elementary School
This project will consist of expanding existing walking track, repairing a portion of existing walking track, repaving existing asphalt playground and demolishing portion of old walking track. As well as seed and straw disturbed areas.
Bids were received, publicly opened, and read aloud in the Office of Facility Planning on June 21, 2023. The bid tabulation is attached.
This item requests approval to award contracts to the low bidders of facility construction projects and reject bids deemed unacceptable in accordance with KRS 162.070.

Recommendation for Approval of Amendment to Memorandum of Understanding with University of Louisville School of Dentistry
JCPS entered into a Memorandum of Understanding with the University Louisville effective July 20, 2022, related to the Dental Assistant Career Pathway at Central High School. Both Parties would now like to extend the MOU to allow for more flexibility in the number of participating JCPS students.
This Amendment amends Paragraph I Clinical Mentorship to the following: Subject to the terms and conditions set forth herein, both Parties will agree on a number of students participating in the Clinical Mentorship Program ("JCPS Students") annually. JCPS shall select its students based on Central High School's Responsibilities. Central High School shall identify and guide eligible students and take such other action as UofL may reasonably request to effectively operate and maintain the program.
The JCPS Students will have the opportunity to observe clinical patient interactions through those University personnel identified by the University prior to the commencement of this MOU. Any University personnel participating in the Clinical Mentorship Program shall complete the required training per the
University's Youth Protection Program, and any other training deemed appropriate by the University.
All other provisions of the MOU shall remain unchanged.
This work supports Vision 2020 strategies 1.1.2 and 1.1.3.

Jefferson County Public Schools (JCPS) and the University of Louisville College of Education and Human Development English as a Second Language (ESL) Endorsement Program continues to collaborate to provide tuition credit to K-12 teachers with elementary certification or secondary content certification seeking to obtain their ESL endorsement through the University of Louisville.
Teachers commit to completing coursework, passing the PRAXIS within one semester of completing all coursework and remaining a JCPS employee for at least three years following the completion of the endorsement. The JCPS ESL Office will use $420,000 in Title II funding to support this project.
This initiative aligns with Vision 2020 strategy 2.2.4, Develop Leaders.

Gold standard research shows that this pedagogical approach improves outcomes in literacy and science for all students. Amplify Education Inc. meets the criteria for Tier III-Promising Evidence as an education
intervention under ESSA.

Recommendation for Approval of Data Privacy Agreement with Aunt Bertha for an Electronic Health Record System
An Electronic Health Record (EHR) was implemented last year to meet needs related to the health & safety of students & staff. This product contains a COVID-19 dashboard that has been essential for rapid response to symptoms & conditions. It will also allow for improved monitoring & follow up of student immunization compliance which is part of the back to school guidelines. Louisville Metro Department of Public Health and Wellness is granting funds to cover first year costs for this product.
The COVID-19 pandemic has revealed widespread disparities in access to health care for many students, families, and staff. Without a true electronic health record (EHR), JCPS cannot obtain and monitor essential data. The ability to monitor for and respond to contagious illnesses across JCPS helps support the district initiative to reduce chronic absenteeism. It also allows our team to monitor physical health information such as compliance with state health requirements to identify schools where students may lack access to health care and to allocate resources based on need. This EHR also allows for documentation of employee health visits in a HIPAA compliant platform. This is needed in order to issue employee quarantine notices, which allow for access to communicable disease, leave and have current dashboards of both student and staff illnesses per JCPS location. We are implementing a staff vaccination program to support employee wellness and must document these visits in an EHR. These measures are all critical to support in-person learning for students, support staff attendance and work to improve equity across the district.

Recommendation for Approval of Data Privacy Agreement Amendment with Identity Automation
This Amendment will update the original description of services portion to add all Rapid Identity modules and include the required data fields collected. The original data protection agreement was approved on August 2, 2022.
Identity Automation is a staff and student solution to various authentication requirements such as multi-factor authentication, single sign-on, and self-service password reset. This system will allow us to manage accounts while providing additional security to all JCPS users. Once implemented, the impact of cybersecurity incidents on students, specifically their personal identifiable information and data, will be significantly reduced.
The purpose of this agreement is to delineate the operational guidelines for sharing data between Identity Automation and JCPS and define the respective roles and responsibilities of each party. Liminex, Inc. dba Go Guardian will provide software that helps schools manage their devices, by providing increased data around student activity and setting advanced security parameters to ensure their safety.
It allows schools and teachers to have greater classroom control and student monitoring capabilities using GoGuardian as a classroom management software.

The Amendment increases the compensation from $10,574.15 to $16,950.26 allowing for two additional schools, Echo Trail Middle School and Dr. J. Blaine Hudson Middle School. If approved, SchoolMint Hero will provide digital educational software (Hero Ready, Hero Rise, and Incident Manager) licenses and support which focuses on supporting pro-social behavior initiatives such as Positive Behavior Interventions and Supports (PBIS), and Social and Emotional Learning (SEL) programs for use at seven designated schools: Frederic Law Olmsted Academy North, Meyzeek Middle School, Johnson Traditional Middle School, Ramsey Middle School, Crosby Middle School, Echo Trail Middle School and Dr. J. Blaine Hudson Middle School.

The terms of the attached partnership agreements follow the National Alliance of Concurrent Enrollment Partnerships (NACEP) standards of practice. These agreements also follow the Southern Association of Colleges and Schools Commission on Colleges (SACS OCS) accreditation standards for credentialed adjunct faculty. Each agreement complies with the Kentucky Dual Credit and Work Ready Scholarship Programs and includes negotiated points outlined in the Postsecondary Partner Institution (PPI) agreement with the Kentucky Higher Education Assistance Authority (KHEAA), which manages the Kentucky Dual Credit and Work Ready Scholarships.

A list of Schoolwide fundraising activities for the 23-24 school year is attached. All activities must follow the current JCPS health and safety guidelines. All activities must follow the current JCPS Accounting/Redbook guidelines and documentation requirements.
Where possible, similar events across multiple schools have been combined to promote administrative efficiency in accordance with the Redbook. Approved activities are for all schools unless noted otherwise. Pursuant to Board Policy 09.33, principals will submit Fundraiser Approval Form F-SA-2a with more detailed information to their area assistant superintendent prior to the start of any fundraising activity.

Recommendation for Approval of Cyber Insurance
On August 13, 2015, KDE proposed 702 KAR 1:170 School District Data Security and Breach Procedures. This regulation specifically cites and recommends compliance with KDE published "Data Security and Breach Notification Best Practice Guide" which provides guidance on preventing and mitigating security breaches.
Cyber policies cover data breaches, whether accidental or via a coordinated hacking attack, and notification costs, as well as the cost of investigating how the breach occurred, who could be affected, and legal assistance to determine notification requirements.
