Rationale

In light of the Governor having declared a state of emergency within the Commonwealth on March 6, 2020, as a result of the COVID-19 outbreak and in compliance with guidance issued by the Executive Branch on March 12 and 16, 2020, regarding the conduct of meetings of state boards and commissions during the emergency period, this meeting will be conducted by video-teleconference and available for live public viewing at the following link: JCBE MEETING VIDEO

Members of the public will have the opportunity to voice opinions or express concerns by submitting remarks via email. Remarks should be limited to 500 words or less and sent to the Assistant Secretary to the Board (angela.gilpin@jefferson.kyschools.us) for dissemination purposes prior to the meeting. Public remarks will be shared with each Board member and recorded in the Official Minutes.

VI.A. Acceptance of Update on JCPS Student Assignment Plan
Rationale

Review of the JCPS Student Assignment plan was undertaken beginning in October of 2017 and included the convening of the Student Assignment Review Advisory Committee which met at least monthly over the course of the review. The result was a series of proposals including modifications to procedures regarding magnet and optional schools and programs as well as a Dual Resides option at middle and high school for students residing in West Louisville.

Following the nearly three years of review and planning, the JCPS Office of School Choice will present an update including the several proposals that have been vetted by the Committee and presented to the community for feedback at various community forums over the course of the review process. These proposals are slated for final review and a vote at the July 21, 2020, meeting.

VI.B. Acceptance of Progress Report on the JCPS Final Corrective Action Plan
Rationale

In accordance with the Settlement Agreement with the Kentucky Department of Education (KDE), JCPS worked with KDE representatives to create a corrective action plan (CAP) to address the deficiencies described in the Management Audit Findings. The Final CAP includes the following areas: (1) Planning, (2) Operations, (3) Finance, (4) Personnel Management, (5) Instructional Management, (6) Career & Technical Education (CTE), (7) Safe Crisis Management (SCM), (8) Individuals with Disabilities Education Act (IDEA), and (9) Early Childhood. The Final CAP supersedes the previous corrective action plans relating to CTE, SCM, and IDEA, which are incorporated, with modest amendments, in the Final CAP.  While KDE noted that JCPS has started the correction process in most if not all of these areas; the official starting point for this Final Corrective Action Plan is October 1, 2018, with October 1, 2020, as the end date.

The Superintendent or his designee will provide monthly status reports to the KDE Commissioner or the KDE Commissioner’s designee related to progress on implementation of the Final CAP, and KDE staff will provide continual feedback, at least monthly, to JCPS related to the progress of JCPS in the implementation of the Final CAP.  In addition, JCPS staff will provide quarterly progress reports to the Jefferson County Board of Education.

This board report will provide a summary of recent actions from the CAP in the areas of Finance and SCM. Attachments include the following documents submitted to KDE: (1) the progress notes from April 2020 and May 2020 and (2) the PowerPoint slides presented to the Kentucky Board of Education on June 3, 2020.

VI.C. Acceptance of Update on the Non-Traditional Instruction Program and the Coronavirus Aid, Relief, and Economic Security (CARES) Act Funding
Rationale

Due to the pandemic caused by the Novel Coronavirus, COVID-19, the District was forced to close schools, clear buildings of most employees, and altered how teachers and school staff delivered instruction to students. In the spring, the District’s Non-Traditional Instruction (NTI) program and the operational supports to make it successful were put in place. 

This update will include the following:

  • the strategies used during NTI to support students and teachers both instructionally and socially;
  • the efforts of the technology team to support students and staff when school was in session virtually;
  • the work of the Special Education department to ensure that students with special needs had their needs met;
  • the work of the Nutrition department to provide meals to students;
  • the communication strategies used to keep families and employees informed;
  • the work of the Human Resource department and the collaboration with unions; and
  • the supports put in place for marginalized student groups.

The District surveyed students, families, and staff to get feedback on the NTI program and highlights are included in the presentation. Overall, 17,000 people responded to the survey to provide feedback.

This update also includes reflections for improvement if the District had to have another round of non-traditional instruction. Focusing on “tech equity” and ensuring that students have access to both technology and wireless capability is a centerpiece of the conversation.

Finally, an update on the funding from the Coronavirus Aid, Relief, and Economic Security (CARES) Act will be discussed.

Rationale

This project will replace the entire HVAC system, electrical switchgear, partial roof replacement, security, fire alarm, ceilings and lights. Exterior windows and minor building renovations may occur.

Pursuant to the requirements of KRS 322.010 and 323.010, et al. and the policies and procedures of the Jefferson County Public School District, a certified and licensed architect or engineer is assigned to all projects that modify, renovate, or construct additions to existing buildings.

The architect or engineer is responsible for the proper preparation of all plans, specifications, estimates, and direct supervision during the execution of the construction contract. The architect or engineer will supervise the bid process, as required by the District’s Model Procurement Code, and provide an appropriate written recommendation to the district.

The Kentucky Department of Education requires approval of this resolution in order to enter into contracts with the design firms of this project. Plans and specifications will be prepared with this approval.

The project directly supports strategy 3.1.1 of Vision 2020.

Rationale

This project will consist of renovating an existing custodial area into a women’s restroom.

On February 11, 2020, the Board of Education approved Studio Kremer Architects to prepare plans and specifications for Project 20-181.

The Kentucky Department of Education, Division of Facilities Management, reviewed the Application for a Building Project, plans and specifications, and approved the taking of bids.

Bids were received, publicly opened, and read aloud in the Office of Facility Planning on June 3, 2020. The bid tabulation is attached.

This item requests approval to award contracts to the low bidders of facility construction projects and reject bids deemed unacceptable in accordance with KRS 162.070.

The project directly supports strategy 3.1.1 of Vision 2020.

On June 26, 2018, the Board of Education approved CMTA, Inc. to prepare plans and specifications for Project 19-002.

On March 12, 2019, the Board approved awarding a contract to Calhoun Construction Services as the low bidder.

CMTA, Inc. has made a final inspection and concluded that this contract is complete and final payment is due the contractor.

Heart of America partners with the Verizon Innovative Learning Initiative (VILS) to transform spaces in participating VILS schools into modern learning environments equipped with state-of-the art technology, furniture and equipment. 

This donation supports Vision 2020 strategies 1.1.1, Adopt a broader definition of learning, 1.1.3, Provide equitable access and 1.1.7, Eliminate achievement, learning, and opportunity gaps.

VII.O.3. Acceptance of Mathematics Achievement Fund Grant from the Kentucky Department of Education
Rationale

The Kentucky Department of Education (KDE) provided elementary schools partial funding to support the hiring of one full-time mathematics intervention teacher and training for the mathematics team consisting of the intervention teacher, principal, and two classroom teachers per school.

Grants were renewed for the 2020-21 school year based on the successful implementation of intervention components, grant requirement compliance, and demonstrated student progress.

Schools were required to select one of four KDE approved mathematics intervention programs. The selected mathematics interventions must meet the needs of the primary students identified as struggling to meet grade level or benchmark expectations for mathematics. The mathematics interventions must supplement, not replace, regular classroom instruction for the students. The following schools received Mathematics Achievement Fund (MAF) grants for 2020-21.

This grant funding supports Vision2020 strategies 1.1.7 and 2.2.1.

The Department will provide five bus drivers for 33 days of service for the summer program.

The funds provided by UPS will support the UPS School-to-Work Program, which employs JCPS high school seniors who will gain work experience and earn college credits by working afternoon shifts as UPS package handlers and taking a college course twice a week in the UPS Training and Education Center located on UPS property.

Funding from UPS supplements the cost for the program’s Teacher of Record for the program.

Rationale

The Kentucky Department of Education awarded 18 elementary schools $47,200 to be used to supplement the salaries of Read To Achieve (RTA) teachers to provide daily intensive intervention for struggling primary students. KRS 158.792 3(b) requires that a school awarded funding provide assurances that the following principles are met:

  • Provide a full-time, full-day, intervention teacher to improve the reading skills of
  • struggling readers.
  • Develop a reading team consisting of the RTA teacher, principal, each +1 classroom teacher and the library media specialist (if the school has a library media specialist/librarian)
  • Implement a grant-approved intervention program
  • Collaborate as a reading team to plan and deliver literacy leadership to build literacy capacity
  • Establish and carry out a system for informing parents of struggling readers of the available family literacy services within the district.
  • Participate in on-going professional learning.

Funds will be used to partially cover RTA intervention teacher salaries, fringe benefits, and expenditures. Schools are required to cover any expenses in addition to the grant. 
The term of the contract is July 1, 2020, through June 30, 2021. There is no financial obligation to the District beyond the grant period.

Baptist agrees to plan, organize and coordinate the sports medicine program for all sports at Atherton High School, Ballard High School, and Jeffersontown High School. Baptist will be recognized as the exclusive sports medicine provider at each of the three schools. This agreement assures that each of the three schools will  have the required  certified medical staff to treat and respond to all student athletes at the participating schools.

Rationale

Dual Credit personnel from Bluegrass Community & Technical College (BCTC) have worked with the principal, administrators, and teachers at JCPS high schools to identify teachers with the necessary credentials to offer dual credit for students scheduled in those courses. This agreement aligns with the new Dual Credit Scholarship Program (2 courses per student lifetime) passed in the 2017 Legislative session and the Work Ready Scholarship (2 CTE Courses per academic year) passed in the 2019 Legislative session. These dual credit courses can transfer to any regionally accredited college or university for credit.

The attached Memorandum of Agreements detail the data exchange commitments, expectations of BCTC, the local school, the local school adjunct faculty, and students. BCTC faculty vet high school teachers by examining their credentials in order to grant the high school teacher adjunct faculty status. Specifically:

  • Scholarship funds may be used for dual credit until the student exceeds their limits or state funds are exhausted. In that case, the student/family is responsible for paying tuition.
  • Tuition is set to 40% of KCTCS tuition (as required by the state regulation KRS 164.786 and KRS 164.787as well as the PPI agreement with the KHEAA)
  • BCTC will not charge JCPS or JCPS students 50% of tuition for unsuccessful students when courses are taught on the high school campus.

The Kentucky Education Reform Act provides for the establishment of Family Resource and Youth Services Centers (FRYSC) which are intended to promote and coordinate the flow of community resources and support to families and youths in ways that strengthen their functioning and that enhance the growth and development of the individual members of the family unit.

The Jefferson County Region 3 allocation for the 2020-21 School year will be $7,820,301.24. (see contract line #13). A letter received on April 29, 2020, from the Cabinet for Health and Family Services specified funding for all Family Resource and Youth Services Centers in Jefferson County. Please note that on April 10, 2020, a docu-signature was submitted to the Commonwealth of Kentucky Cabinet for Health and Family Services pending Board approval due to contract timelines.

Rationale

JCPS is obligated to provide a free and appropriate public education for all children and youth with disabilities ages 3-21. Due to the program limitations for highly specialized populations, JCPS recognizes the need to provide educational programming for students with disabilities specifically Deaf/Hard of Hearing.  The Heuser Hearing and Language Academy can provide an appropriate education to District students because the facilities offer highly specialized programs to specific populations.

Through a Memorandum of Agreement, which is revised and signed annually, the District and the Heuser Hearing and Language Academy have mutually agreed to provide services that will enable these students to receive a free and appropriate public education based on their individual level and unique needs. Students' programs are monitored to ensure that all due process procedures are followed.

The attached agreement shall be effective July 1, 2020, and ending on June 30, 2021.

This project supports Vision 2020 Strategy 1.1.1.

Rationale

Jefferson County Public Schools (JCPS) is entering into a Data Sharing Agreement (DSA) with International Data Center (IDEC) to provide reading assessment data for first grade students who participate in the Reading Recovery program. Reading Recovery is a preventive 20-week intervention for first graders with the greatest difficulties learning to read and write. It is an evidence-based program with an average 77 percent success rate among Kentucky students. IDEC collects data and creates reports to evaluate the effectiveness of individual Reading Recovery programs across the country, and they publish a report annually examining national trends.

There is no cost to JCPS to conduct the study. This research supports Vision 2020 Strategy 1.1.5 Improve student literacy.

Rationale

JAMF Pro is a device management program provided to us as part of the Verizon Innovative Learning (VILS) grant. Jamf is the industry standard when it comes to the management of iOS devices (iPads and iPhones), macOS computers (MacBooks, iMacs, etc.), and tvOS devices (Apple TV). It is used to set up and pre-configure new devices, enhancing the user out of box experience (OOBE). JAMF Pro allows us to manage the VILS iPads from a variety of aspects, including, but not limited to, developing configurations and policies that connect our students to digital learning opportunities, while still setting parameters that protect them online. In addition to establishing an infrastructure of support for the iPads, JAMF also allows us to be in continuous communication with each device. Through their device management platform, we are able to assign applications directly to the device as well as reset, re-purpose, and recover the device when it has been lost or misplaced.  

The purpose of this agreement is to delineate the operational guidelines for sharing data between JAMF and JCPS and define the respective roles and responsibilities of each party. Data sharing will begin upon acceptance of this agreement. All procedures and processes will be FERPA compliant. Period, scope, and protections are also outlined in the attached agreement. Rationale

The Exceptional Child Education (ECE) department proposes to collaborate with Jefferson Community and Technical College (JCTC) to offer pre-employment transition services (Pre-ETS) for JCPS students. The Office of Vocational Rehabilitation authorizes agencies to be Community Rehabilitation Partners (CRP) in order to provide pre-employment transition services to students. The ECE department seeks to increase transition/post-secondary opportunities for our students receiving special education services.

The JCTC’ Pre-ETS Program, provided through their Community Rehabilitation Partner credential, is designed to assist ECE students who qualify to receive services from the Office of Vocational Rehabilitation (OVR) and who have identified employment as a desired post-school outcome. Additionally, these students will have demonstrated a need for vocationally relevant transition services in order to successfully transition from high school to employment. Pre-ETS services will be provided in the areas of job exploration counseling, work-based learning experiences, counseling on post-secondary transition, workplace readiness training, and instruction in self-advocacy.

JCTC will provide eligible students with transition services through collaboration with JCPS staff. Approval of the attached third-party cooperative agreement will allow the district to participate in the partnership.

There is no cost to the District. The Office of Vocational Rehabilitation funds the work of CRPs.

Rationale

This renewal is under the same terms and conditions as the original Lease Agreement/Land Swap approved by the Jefferson County Board of Education on June 12, 2012, and may be extended for successive terms of one year each, up to a maximum of 99 years, contingent on approval by the Jefferson County Board of Education on an annual basis. 

The Lease Agreement/Land Swap is based on mutual and equal benefit for both Louisville Metro Government and Jefferson County Public Schools. This arrangement allows for a driveway for Fairdale Elementary School and a recycling drop-off point for Louisville Metro. On the attached aerial view of the Fairdale Elementary property, there is an area marked in red and designated as the proposed swap. This long, rectangular piece of property is part of our driveway. Without this piece of land, it would impede access to our school. 

This item supports Vision 2020 Goal Infrastructure Improvements.

The Memoranda of Agreement will serve to ensure a common structure, language, comprehensive coverage of issues, and clarity of responsibility for each organization in terms of services.  The Data Sharing Agreements serve to facilitate the protection of data and student privacy.

This memorandum of agreement and data sharing agreement address BLOCS; the other initiatives will be addressed in separate agreements.

Building Louisville’s Out-of-School Time Coordinated System (BLOCS)

On November 13, 2012, the founding partners of JCPS, MUW, and LMG formalized their commitment to out-of-school time system building efforts in Louisville by signing the Louisville Out-of-School Time Coordinating Council Charter, known today as BLOCS. BLOCS is guided by the recommendations in YouthPrint, which was approved by the heads of the partner organizations on December 20, 2010. The founding BLOCS organizations have chosen to pursue this work in collaboration as a "community partnership" and adhere to the following definition: Community partnerships are "mutually beneficial and well-defined relationships entered into by two are more organizations to achieve results they are more likely to achieve together than alone."

This agreement supports Vision 2020 strategy 1.1.7 – Eliminate achievement, learning, and opportunity gaps.

This memorandum of agreement addresses United Community. In accordance with the memorandum of agreement, a related data sharing agreement will be submitted at a later date for approval to the Board before the distribution of Unite US licenses to District employees and before any exchange of data; the other initiatives will be addressed in separate agreements.

United Community

On June 11, 2019, the Board approved a MOA with Metro United Way, Inc. to implement United Community in District schools, as described below. Under that agreement for 2019-20, the District would have paid $200,000 and would have received 273 licenses for the United Community Data Platform provided by Unite US, as well as training and support. Due to technical challenges relating to systems integration, and delays relating to the COVID-19 pandemic, the terms of the agreement were not competed in 2019-20. This MOA carries forward the same terms of the previous agreement for implementation in 2020-21.

With regard to the United Community initiative, on October 30, 2018, the Board approved a MOA expressing the commitment of the District to participate in the United Community initiative, a broad coalition of community partners coming together to implement a shared technology platform to help Louisville address the social determinants of health by linking education, health, and social services in one interconnected data and referral system.  The creation and implementation of the technology platform to share data among doctors' offices, hospitals, schools, and social service organizations at multiple touchpoints, will streamline access, navigation, and coordination of available resources. This "no wrong door" solution ensures those who need support are quickly referred and served, which will be a dramatic improvement over current care referral in Louisville; ensures those who need support are quickly referred and served, which will be a dramatic improvement over current care referral in Louisville.

Newsela provides content at differentiated consumption levels along with integrated assessments via their website, the Newsela mobile application and any other websites or applications of Newsela, Inc. Services include ongoing upgrading of the consumption level algorithm, communications with teachers and administrators in support of their use of the product, as well as the benefits of related research and development, improvements and supplements supporting the Newsela offerings, their website and/or the mobile application.

The purpose of this agreement is to delineate the operational guidelines for sharing data between Newsela and JCPS and define the respective roles and responsibilities of each party. Data sharing will begin upon acceptance of this agreement. All procedures and processes will be FERPA compliant. Period, scope, and protections are also outlined in the attached agreement. There is no cost to the district for the data sharing agreement. This supports Vision 2020 strategy 3.1.1- Improve physical infrastructure.

VII.P.18. Recommendation of Collaborative Agreement with the University of Louisville
Rationale

The University of Louisville’s Advanced Educational Leader program has been completely redesigned in partnership with leaders of all 15 districts (including JCPS) in the Ohio Valley Educational Cooperative.

This collaborative effort will allow certified JCPS candidates to receive the following benefits:

  • New, bundled and reduced tuition starting August 2020 of $3,000 per semester for five semesters, and includes all textbooks, fees, certification test preparation, 2 years of membership in 3 professional organizations, and cohort-based field trip(s). This represents a substantial discount from current tuition-only levels
  • Five semester, 30-hour program qualifies the Ed.S. degreed graduate for both Level 1 and Level 2 Certification as Principal and Instructional Supervisor. It also qualifies for Rank I compensation.
  • Hybrid Delivery - Face to face class meetings and/or on-line attendance in the same class. Class meets one evening per week and remains consistent throughout the program
  • Two one half semester consecutive courses each term to allow deeper coverage and focus on each course topic
  • Payback on the investment in their education in less than a single year (if moving into a school leadership position), and it will continue to pay professional and financial dividends for the remainder of their career.

In addition to the program design, candidates will be granted a degree from the University of Louisville, a nationally recognized and highly regarded research University.

The Memorandum of Agreement is effective beginning August 14, 2020, and ending June 30, 2021. 

This program supports Vision 2020 Strategy 2.2.4

VII.P.19. Recommendation for Approval of Data Sharing Agreement with the University of Kentucky College of Education to Implement Online Civics Assessment
Rationale

In 2017, the Kentucky General Assembly passed Senate Bill 159. According to the law, beginning in July 2018, a student must pass a civics test composed of 100 questions from the United States Citizenship and Immigration Services test to graduate from a public high school with a regular diploma. In order to pass the test, each student must answer at least 60 percent of the questions correctly.   

The Kentucky Department of Education collaborated with the University of Kentucky: OTIS Digital Driver’s License System for Civics Test to offer a multiple-choice version of the civics test.  This data sharing agreement provides for the University of Kentucky: OTIS Digital Driver’s License System for Civics Test to use student and staff level data to provide student and staff access to the civics test assessment and reporting tools in order to meet the graduation requirements as outlined in Senate Bill 159. Data sharing agreements are best practice for protecting student level data.

VII.P.20. Acceptance of Amendment to the Sub-award Agreement for the Institute of Education Sciences Grant with Teachers College, Columbia University
Rationale

The US Department of Education, Institute of Education Sciences, awarded a grant to Teachers College, Columbia University in partnership with JCPS to research whether and how cycle-based budgeting and the concept of academic return on investment can be used to improve decision-making about educational programs and strategies, and ultimately lead to stronger student education outcomes.  

The no-cost extension amendment covers the cost for a JCPS program analyst to support the grant activities. The original agreement was approved by the Board on July 24, 2018. A match is not required and the sub award does not obligate the District after the period of performance.

The grant supports Vision 2020 strategy 3.1.4 Ensure responsible stewardship of resources.

This Fund is designed to provide scholarship assistance in the form of grants to help defray expenses of disadvantaged students graduating from any public high school in Jefferson County that is managed, controlled and governed by the Jefferson County Board of Education and attending a college, university or post-secondary educational institution.

The attached Amendment revises and modifies the JCPS Employee Sponsored Student Scholarship Fund Agreement dated June 26, 2018, as stated in the attached document.

This is an employee sponsored scholarship fund with twenty payroll deductions per year for those wishing to contribute. Deductions will begin September 2020.

This Agreement supports Vision 2020 strategy 1.1.3 Provide equitable access.

Rationale

The MIKVA Challenge supports Vision 2020 Deeper Learning Goals 1.1.1, 1.1.2, and 1.1.3 by transforming the instructional core to create deeper learning experiences in social studies for all students. The work with MIKVA Challenge will support the Vision 2020 action plan by supporting teachers and leaders in shifting social studies instruction from transmissive direct instruction to transformative inquiry-based learning in which students engage in multi-step real-world and abstract problems using critical reasoning and understanding by focusing on sourcing and how to use sources to promote inquiry-based learning.

It also provides support for improving teaching and learning to accelerate student growth around taking informed action in classroom and communities. MIKVA Challenge provides job-embedded professional learning through Professional Learning Communities focused on systems improvement to ensure that every classroom and every school has a strong learning climate and culture of learning.

This contract with MIKVA Challenge includes $60,000 per year funding from Mikva and $40,00 per year from JCPS to provide services through the 2022-2023 school year.

VII.P.23. Recommendation for Approval of Memorandum of Agreement with Metro United Way, Inc. Regarding Early Childhood Education
Rationale

Jefferson County Public Schools and Metro United Way (MUW) have a long-standing partnership to serve the students of Jefferson County through various key initiatives, including (1) Early Childhood Education; (2) BLOCS; and (3) United Community.  The District is working to systematize and coordinate the agreements that govern those initiatives.

The Memoranda of Agreement will serve to ensure a common structure, language, comprehensive coverage of issues, and clarity of responsibility for each organization in terms of services.  The Data Sharing Agreements serve to facilitate the protection of data and student privacy.

This memorandum of agreement and data sharing agreement address early childhood education; the other initiatives will be addressed in separate agreements.

Early Childhood Education

MUW coordinates a broad coalition of community partners that help Louisville address challenges associated with early childhood education and improve Kindergarten readiness through the Ready for Kindergarten Alliance. To achieve this goal, MUW implements several early childhood programs and monitors physical, emotional, and academic developmental progress of Louisville-area students birth to Grade 12. Metro United Way is serving as the lead organization and fiscal agent for the Ready for Kindergarten Alliance, including the Excellence Academy, Pathways, and Ages and Stages Questionnaire (ASQ) and regularly evaluates the effectiveness of these programs; and JCPS supports MUW and community partners with the Ready for Kindergarten Alliance in effort to connect JCPS students and families with support services to remove barriers to early learning and long-term student success. 

This agreement supports Vision 2020 strategy 1.1.7 – Eliminate achievement, learning, and opportunity gaps.

Rationale

External support/booster organizations are adult/parent organizations established to promote school programs or complement student groups or activities, (i.e., PTA, PTO, booster organizations, etc.). 

An external support/booster organization's purpose is to promote school programs, student groups, or activities at schools. Although external support/booster organizations work very closely with the District, they are separate legal entities and are responsible for adherence to IRS guidelines and Title IX regulations. 

Pursuant to Kentucky Department of Education Accounting Procedures for the Kentucky School Activity Funds Redbook Incorporated by Reference in 702 KAR 3:130, new external support/booster organizations must receive local board approval to establish, lend support, seek assistance, or fundraise in the name of the district, school, students, or a district or school program. 

In addition to each school having a PTA/PTSA/PTO, the External Support/Booster Organizations listed in the attachment request Board approval and have submitted appropriate documentation as required under the External Support/Booster Organizations General Guidelines of the Redbook

The organizations' officers are solely responsible for ensuring that their group is in compliance with District policies, external support/booster organization guidelines in the Redbook, and state and federal regulations.

Rationale

The Department of Workers’ Claims requires each individually self-insured to carry excess insurance with an indemnity limit of “Statutory” or at least $10,000,000 per occurrence and a retention level of $1,000,000. The policy will provide a specific retention of $1,250,000 with no corridor deductible. The premium is based on payroll but is estimated to be $230,117.

The rate is 0.0261 per $100 of payroll. STAR Insurance Company has an “A” AM Best rating.

Rationale

Board policies 09.428 Student Rights and 09.438 Student Support and Behavior Intervention Handbook and KRS 158.148 establish a process and timeline for the review of the Code of Acceptable Behavior and Discipline and The Student Bill of Rights (Code). 

The Student Support and Behavior Intervention Handbook has been updated to reflect changes in JCPS Board Policy, Kentucky Revised Statute, KSBA Policy, and Kentucky Statute. Outside these aforementioned changes, content for the 2020-21 Student Support and Behavior Intervention Handbook remains mostly unchanged.  Slight changes were made to existing content to emphasize or clarify key points.  Additional changes occurred as a result of a further review of the document. Language was added to expand the definition Profanity/Vulgarity code to include Hate Speech and Racial Slurs. Additionally, language was added under the evidence-based practices to include the importance of a culturally responsive classroom climate.

The draft Student Support and Behavior Intervention Handbook is attached for Board approval for implementation during the 2020-21 school year.

A broad-based committee reviewed and revised the policies and procedures outlined in the 2020-21 Student Progression, Promotion, and Grading Handbooks for the elementary, middle, and high schools.  The committee reviewed the procedures and conducted a review applying the district’s Racial Equity Analysis Protocol. This item supports Vision 2020 strategy 1.1.3- Provide equitable access.
