Rationale

KRS 156.160 (2) allows the Kentucky Board of Education to grant waivers to regulations when appropriate justification is submitted in writing.     

702 KAR 4:050 Section 4(4)(b) reads in relevant part “The property shall not have easements traversing the site. Easements are allowable along perimeter. Commitments to relocate easement from traversing site to perimeter shall be considered.” The property being donated to Jefferson County Public Schools at 18th Street and West Broadway has a 50’ Sewer and Drainage Easement traversing the property. The easement serves as drainage for storm water. Efforts will be made during design to relocate the drainage easement; however, it may become cost prohibitive. There is space on either side of the easement to construct a new school. There is also a portion of an existing 60’ Public Right of Way that includes a Louisville Gas and Electric Easement, a Louisville Water Company water line, and a Louisville/Jefferson County Metropolitan Sewer District 18” sanitary sewer that traverses through the property. The easement and water/sewer lines are not in an area where the school will be built and are not a factor in design.

WHAS Crusade for Children awarded funds in the areas of Occupational and Physical Therapy and Early Childhood Education.

The District is not required to match funds on these projects and has no obligation beyond the end date of the grant period.

Rationale

Approval of the 2025 Affiliate Partner Agreement with the Alliance for Young Artists & Writers, Inc. will expand opportunities for students in grades 7-12 visual arts programs. The Scholastic Art Awards program directly impacts students’ college/career readiness. The program is aligned with curriculum standards that support visual arts program goals, college/career portfolio preparation, and enrichment opportunities.

Costs associated with this program are split between JCPS and the Fund for the Arts. The Fund for the Arts covers all student entry fees for participating non-JCPS students. JCPS student participation fees, national program costs (e.g., website maintenance, certificates, marketing materials, program support, etc.), plus print (e.g., programs, posters, labels, certificates, etc.) and office supplies are paid from the Academics department fiscal budget. The Alliance’s student entry fees are $10.00 for individual artwork submissions and $30.00 for senior art portfolio submissions. The budget estimate for the 2025 program is $8575 for JCPS students and $4000 for non-JCPS student participation. This agreement directly supports strategies 1.1.3 Provide Equitable Access, 1.1.1 Adopt a Broader Definition of Learning, and 1.1.2 Personalize Learning in Vision 2020.

Rationale

Dual Credit personnel from Elizabethtown Community and Technical College have worked with the principals, administrators, and teachers at various JCPS High Schools to identify teachers with the necessary credentials to offer dual credit for students scheduled in those courses. Participating High Schools will provide written notification of the courses they plan to offer prior to each semester and/or academic year. 

The terms of this partnership agreement follow the National Alliance of Concurrent Enrollment Partnerships (NACEP) standards of practice. This agreement also follows the SACS OCS accreditation standards for credentialing adjunct faculty. This agreement complies with the Kentucky Dual Credit and Work Ready Scholarship Programs and includes negotiated points outlined in the Postsecondary Partner Institution (PPI) agreement with the Kentucky Higher Education Assistance Authority (KHEAA), which manages the Kentucky Dual Credit and Work Ready Scholarships. This college provides appropriate dual credit courses to all JCPS high school students and high schools participating in dual credit.

This MOA provides for coordination between Head Start and JCPS as required by 45 CFR 1302.53 and 45 CFR 1302.63. The Kentucky Department of Education also requires the Head Start director and JCPS representative to jointly complete and sign the Certificate of Head Start Full Utilization by September 15, 2024, to verify the number of at-risk four-year-olds enrolled with Head Start and confirm that Head Start is fully utilized on September 1, 2024.

Kentucky Refugee Ministries will recruit students and provide space for the program. The District will provide ELD/ESL teachers and bi-lingual  instructors for the program and curricular and instructional materials and resources for students and staff.
This project aligns with Vision 2020 strategy 1.1.5 improving student literacy and strategy 1.1.7 providing differentiated resources to eliminate opportunity gaps.

Schools will refer students to LAM for private music lessons based on an agreed set of criteria, including financial need. LAM will provide all lesson books and all supplementary materials for students and provide an accompanist for student solo performances as part of school concerts.

This contract allows the District to continue it's partnership with Visually Impaired Preschool Services (VIPS) to provide preschool aged students within our community who are eligible for vision services to receive the appropriate services outlined in their Individual Education Plan in the least restrictive environment with same-aged peers. JCPS is obligated to provide an appropriate education for all children and youth identified with special needs age 3-21 residing within Jefferson County School District.

VIII.R.24. Recommendation for Approval of Memorandum of Agreement with Volunteers of America
Rationale

This agreement with Volunteers of America has allowed the District to collaborate with a community partner who has provided targeted social services with rolling case management to support families and students. Through this collaboration, JCPS has been able to accept referrals of identified students with extreme behavioral and environmental challenges to implement restorative justice practices to address contributing factors and impact of the student's behavior while engaging the family and school personnel to develop a partnership and provide case management to coordinate services and support to promote future success. Volunteers of America RJ has also contracted with certified interpreters specially trained for case management oral interpretation to help support families and ensure culturally and linguistically responsive coordinated care. The use of the US Department of Education Project Prevent Grant funds was approved by the JCBE in March. This is the second year of the grant and the services provided to families in this agreement is a critical portion of the grant activities.

VIII.R.25. Recommendation for Approval of Memorandum of Agreement with Western Kentucky University for Dual Credit
Rationale

Dual Credit (DC) personnel from Western Kentucky University have worked with the principal, administrators, and teachers at various JCPS High Schools to identify teachers with the necessary credentials to offer dual credit for students scheduled in those courses. High Schools will provide written notification of the courses they plan to offer prior to each semester or academic year. 

The terms of this partnership agreement follow the National Alliance of Concurrent Enrollment Partnerships (NACEP) standards of practice. This agreement also follows the SACS OCS accreditation standards for credentialing adjunct faculty. This agreement complies with the Kentucky Dual Credit and Work Ready Scholarship Programs and includes negotiated points outlined in the Postsecondary Partner Institution (PPI) agreement with the Kentucky Higher Education Assistance Authority (KHEAA), which manages the Kentucky Dual Credit and Work Ready Scholarships. This college provides appropriate DC courses to all JCPS high school students and high schools participating in DC.

This Agreement establishes a framework for the Vendor to provide the following services for the implementation of the parent-pay option:

  • Automated Vendor Data Validation: This ensures the accuracy and completeness of vendor data by automatically verifying it against predefined criteria.

Data Sharing and Security:

VIII.S. Recommendation for Approval of 2024-2025 Schoolwide Fundraising Activities
Rationale

A list of Schoolwide fundraising activities for the 2024-25 school year is attached. All activities must follow the current JCPS health and safety guidelines. All activities must follow the current KDE and JCPS Accounting/Redbook policies and guidelines including all documentation requirements. All individual school fundraising activities were submitted and reviewed by the appropriate Zone Assistant Superintendent. Similar events across multiple schools have been combined on the attached list to promote administrative efficiency in accordance with the Redbook. As required, the specific details for each planned fundraiser is included on the Redbook FSA-2A Fundraiser Approval Form.  Participation in fundraisers is always optional. When approved, all activities on the attached list are an option for all schools unless noted otherwise.

Schoolwide fundraisers are defined as “organized activities of soliciting and collecting money for the benefit of ALL students of a school.”  All schoolwide fundraisers that involve students with sales and collections where the entire student body benefits, must be approved by the Jefferson County Board of Education (JCBE). This includes school, PTA, PTSA, Booster, or Alumni fundraisers. It does not include service project fundraisers such as Jump Rope for Hearts or canned good drives, or any activity that funds a specific student organization or general activity, such as athletics. Fundraising activities may only be approved by the Jefferson County Board of Education (JCBE) and principals.

Rationale

Each year, the Kentucky School Boards Association (KSBA) provides local boards of education with a Board Policy Update, which includes recommended amendments to board policies based on changes during the preceding year to state and federal statutes and administrative regulations.

The attached document shows proposed amendments to Board policies from the 2024 Annual KSBA Board Policy Update, incorporating suggested language from the Board Policy Committee, District staff, and the General Counsel.  Proposed new language is underlined, and proposed deletions are shown using strikethroughs. JCPS recommended new language is highlighted.

KRS 160.340 requires board policies be kept up to date with annual amendments by August 15.
