The Yes I Can! Transition Award recognizes students and youth with exceptionalities who have demonstrated achievement that far exceeds expectation in acquiring knowledge, skills and/or abilities that resulted in successful outcomes in their work, vocational training, or independent living.

Congratulations to Layne Elementary School on being named one of America’s Healthiest Schools by the Alliance for a Healthier Generation. 

Alliance for a Healthier Generation works alongside schools, families, and communities to advance whole child health equity. Its annual recognition program honors schools for adopting best practices to advance the physical, mental, and social-emotional health of their staff and students.

Layne was honored at the America’s Healthiest Schools Leaders Summit in October in Washington, D.C.

This information update will allow the Board to see the progress the District has made and the impact it is having on student learning, as well as hear from stakeholders on their experiences thus far.

This project consists of replacing the obsolete old fluorescent light fixtures in the hallways with LED light fixtures.

Pursuant to the requirements of KRS 322.010 and 323.010, et al. and the policies and procedures of the Jefferson County Public School District, a certified and licensed architect or engineer is assigned to all projects that modify, renovate, or construct additions to existing buildings.

The architect or engineer is responsible for the proper preparation of all plans, specifications, estimates, and direct supervision during the execution of the construction contract. The architect or engineer will supervise the bid process, as required by the District’s Model Procurement Code, and provide an appropriate written recommendation to the district.

The Kentucky Department of Education requires approval of this resolution in order to enter into contracts with the design firms of this project. Plans and specifications will be prepared with this approval.

The project directly supports strategy 3.1.1 of Vision 2020.

Rationale

This project is a contract for the incidental removal of asbestos and lead materials in schools for the Fiscal Year 2023-2024.

The price contract is required in order to comply with the school district’s AHERA (Asbestos Hazard Emergency Response Act) management plans. Compliance with the management plans began on July 9, 1989.

The Kentucky Department of Education, Division of Facilities Management, reviewed the Application for a Building Project, plans and specifications, and approved the taking of bids.

Bids were received, publicly opened, and read aloud in the Office of Facility Planning on November 8, 2023. The bid tabulation is attached.

This item requests approval to award contracts to the low bidders of facility construction projects and reject bids deemed unacceptable in accordance with KRS 162.070.

The project directly supports strategy 3.1.1 of Vision 2020.

Rationale

This project will consist of expanding an existing parking lot for additional parking.

On April 25, 2023, the Board of Education approved Mindel Scott to prepare plans and specifications for Project 23-437.

The Kentucky Department of Education, Division of Facilities Management, reviewed the Application for a Building Project, plans and specifications, and approved the taking of bids.

Bids were received, publicly opened, and read aloud in the Office of Facility Planning on October 10, 2023.  The bid tabulation is attached.

This item requests approval to award contracts to the low bidders of facility construction projects and reject bids deemed unacceptable in accordance with KRS 162.070.

Rationale

The Louisville Water Company (LWC) easement allows for the purpose of connecting, construction, operating, maintaining, reconnecting, repairing, removing, reconstructing, replacing, and/or enlarging one or more water mains and appurtenances. The LWC easement is for valuable consideration of $4,545 and includes a reversionary clause that reverts the property back to the district when the need for the easement no longer exists.

The granting of the above easements will not affect the integrity or usefulness of the property crucial to the educational needs of the District.

These items directly supports Vision 2020 Goal Infrastructure Improvements.

Rationale

On October 6, 2022, the original grant was accepted. The period of performance was October 1, 2022 to September 30, 2023. This amendment extends the period of performance until November 30, 2023.

Kentucky Educational Television (KET) has included JCPS Information Technology in the Kentucky Online Learning Experience Collaborative. The JCPS Innovation Technology division will be asked to select a Networked Improvement Team. The grant covered costs for the team to travel to KET or other location for in-person training identified by the Online Learning Experience Collaborative.

The grant also provided opportunities for JCPS Innovation Technology staff to attend educational conferences in support of the District’s online/virtual/remote learning program.  

Matching funds are not required and the grant does not obligate the District beyond the period of performance.

Rationale

Dual Credit personnel from Kentucky State University have worked with the principal, administrators, and teachers at various JCPS High Schools to identify teachers with the necessary credentials to offer dual credit for students scheduled in those courses. Specific courses are listed in the agreement for each school. 

The terms of this partnership agreement follow the National Alliance of Concurrent Enrollment Partnerships (NACEP) standards of practice. This agreement also follows the SACS OCS accreditation standards for credentialing adjunct faculty. This agreement complies with the Kentucky Dual Credit and Work Ready Scholarship Programs and includes negotiated points outlined in the Postsecondary Partner Institution (PPI) agreement with the Kentucky Higher Education Assistance Authority (KHEAA), which manages the Kentucky Dual Credit and Work Ready Scholarships. This college provides appropriate DC courses to all JCPS high schools students and high schools participating in DC.

This Amendment will update the original data protection portion within the Master Service Agreement with KnowledgeLake. This will ensure that KnowledgeLake shall comply with all applicable federal, state, and local laws, rules, and regulations pertaining to data privacy and security.

KnowledgeLake allows JCPS departments to automate critical business functions, such as accounts payable and receiving, claims processing, case management, HR onboarding, and other document processing use cases within Microsoft Azure and SharePoint environments. 

Specifically, within Finance and Accounts Payable, KnowledgeLake implemented 2-5 bots to read and capture metadata from vendor invoices, key certain data into MUNIS Accounts Payable module, & upload invoice attachments to TCM. This automation replaced the need for (2) full-time AP clerks.

XI.V.19. Recommendation for Approval of Confidential Data Privacy Agreement with NCS Pearson, Inc.
Rationale

NCS Pearson's BESS Mental Health Screener is an assessment for measuring mental health in 6–12th grade students in hopes to better identify students that may be struggling. This will be a renewal of the optional screening used where parents can choose to have their child opt out of the screening. Data will be used to help address students’ mental health needs and more effectively connect them with resources in the school and community.

The purpose of this renewal agreement is to delineate the operational guidelines for sharing data between NCS Pearson, Inc. and JCPS and define the respective roles and responsibilities of each party. Data sharing will continue upon acceptance of this agreement. All procedures and processes will be FERPA compliant. Period, scope, and protections are also outlined in the attached agreement.

Rationale

McFerran Preparatory Academy and Academy @ Shawnee will implement the Full-Service Community School (FSCS) services which will be funded by the Prichard Committee for Academic Excellence. The FSCS grant will advance the work of the existing programs at McFerran Preparatory Academy and The Academy @ Shawnee.

The purpose of the grant is to decrease inequitable access to programs by improving student achievement, reducing dropout rates, increasing college enrollment, and better overall health and well-being of students and families—particularly in high-poverty schools, therefore addressing the root causes listed above.

Squallis Puppeteers will provide a puppet making and storytelling workshop at the J. B. Atkinson Academy at no cost to the school. Squallis Puppeteers will also provide performances of “Rage-o-saurus Rex” for preschool and kindergarten students at Blake and Okolona Elementary Schools at no cost to the schools.

Other JCPS schools may request performances or workshops by Squallis Puppeteers based on the pricing schedule included in Attachment A. Those schools will pay Squallis directly. The period of performance is December 6, 2023, through June 30, 2024.

University of the Cumberlands and the Board of Education are parties to a Student Teacher Agreement effective July 1, 2023. The parties desire to amend the Student Teacher Agreement in order to implement the University of the Cumberlands Student Teaching Policy for Substitute Teaching according to the parameters set forth in this Amendment. This Amendment is in addition to, and does not replace, the Student Teacher Agreement, all terms and provisions of which remain in full force and effect except as specifically provided herein.

Rationale

Jefferson County Public Schools (JCPS) is entering into a Memorandum of Agreement regarding data sharing with University of Louisville College of Education and Human Development (UofL CEHD) to provide deidentified state assessment data for students of UofL CEHD educators and non-UofL CEHD educators. The data will provide UofL CEHD information to make data informed decisions and will additionally support UofL CEHD accreditation processes. UofL CEHD is focused on improving JCPS student academic outcomes by graduating educators that are making a positive impact.

There is no cost to JCPS. This research supports the Vision 2020 Strategy 1.1.7 Eliminate achievement, learning, and opportunity gaps.

Data sharing will begin upon acceptance of this Agreement and will terminate when the services terminate. All procedures and processes will be FERPA compliant. XI.V.34. Recommendation for Approval of Contract Modification with the Kentucky Department of Education
Rationale

The 21st Century Community Learning Centers initiative provides academic, artistic, and cultural enrichment opportunities to children, particularly students who attend high poverty and low-performing schools, to meet challenging state standards, and local standards in core academic subjects, such as reading, math, and science.

The purpose of this Contractual Memorandum of Agreement with the Kentucky Department of Education is: 

  • To provide students with homework assistance and a broad array of activities that can complement their regular academic programs while also promoting youth development; and offering literacy and other skill-building educational services to the parents and families of participating children.
  • To increase academic achievement by ensuring that students have access to high-quality academic and engaging enrichment activities that support their learning and development. The 21st CCLC initiative further stresses the importance of diverse groups and organizations working together to strengthen school and community networks to help students and families succeed. Funds will enable schools and communities to design and implement effective out-of-school programs that will result in improved student achievement and be sustained through community partnerships after the grant funds end.

XI.W. Recommendation for Approval of Shortened School Day for One Exceptional Child Education Student
Rationale

The Kentucky Administrative Regulations, as outlined in the Exceptional Child Education Policies and Procedures Manual, requires that a shortened school day and/or week be submitted to the Board of Education for approval.

This Board action is subject to confidentiality requirements according to policies and procedures in Chapter 9 Confidentiality of Information. Following approval by the Board of Education, the request will be submitted to the Kentucky Department of Education, Division of Learning Services.

The District must maintain the following documentation for all shortened school days and/or weeks approved by the Local Board of Education:

  • approval by the Local Board of Education (student confidentiality procedures must be followed when listing student information in the local Board minutes);
  • minutes of the Admissions and Release Committee (ARC) meeting documenting the ARC decision that a shortened school day and/or week is needed;
  • a copy of the student’s Individual Education Plan documenting the shortened school day and/or week; and
  • a copy of the physician's statement of the medical need.

Per regulations, the students are being identified as SSD295 rather than by name.

Student SSD29 has a medical condition, with proper physician documentation, which requires a 2 hour  and 50 minute school day, five days a week. Appropriate ECE procedures have been followed for this student, who is being served in a resource room in a special school setting.

XI.Y. Recommendation for Approval of 2023-2024 Comprehensive District Improvement Plan
Rationale

The 2023-24 Comprehensive District Improvement Plan (CDIP) includes the following components: (1) District Assurances, (2) Executive Summary, and (3) Improvement Plan (including support for TSI and CSI schools).

Our plan consists of the 17 district-level actions identified in Vision 2020 In Action, approved by the Board in July 2018. The CDIP includes goals and strategies that address the District’s three focus areas of student learning, culture and climate, and organizational coherence.

The plan represents our past, present, and future by including strategies from Vision 2020 In Action, state requirements, and the JCPS Future States.

As we move forward with establishing new Board Goals and Guardrails, our plan for next year will be focused on the key strategies needed to reach our goals.

XI.Z. Recommendation to Waive the Requirement Under Board Policy 01.411 to Fill the Current Vacancy of the Office of the Board Chairperson on or Before the Second Meeting Following the Vacancy and Defer Election to the Organizational Meeting in January 2024
Rationale

Board Chairperson Diane Porter resigned her position as a member of the Board on Tuesday, October 24, 2023.

Board Policy 01.411 Duties and Responsibilities of the Chairperson and Vice-Chairperson states:

If for any reason the office of the Chairperson becomes vacant, the Vice-Chairperson shall act as Chairperson until a new Chairperson is elected and perform all duties of the chairperson when acting in that capacity. A new Chairperson shall be elected on or before the second regular meeting date following the vacancy and shall serve until the first regular organizational meeting in January.

The Board meeting to be held on December 5, 2023, is the only regular board meeting scheduled prior to annual Organizational Meeting of the Board to be held on January 23, 2024. Under the authority of KRS 160.160, Board Policy 01.41 requires the Board to elect a Chairperson and Vice-Chairperson to serve one-year terms at the January Organizational Meeting.

A waiver of the requirement to elect a new Chairperson on or before the second meeting after this vacancy is appropriate because there is only one remaining meeting of the former Chairperson’s term, and the selection of a person to fill the District One vacancy will not have been completed. By approving the waiver, the Board will maintain stability through the transition process, and allow all seven Board members participate in the election of Board leadership in accordance with the normal schedule for elections at the annual Organizational Meeting.

The attached updated document is recommended for approval to update the District’s salary schedules for the 2023-24 school year. 

Approval of this recommendation will authorize staff to extend the applicable salary schedule changes and Salary Placement Rules updates to District employees effective December 9, 2023.
