Consider Ordinance 8-2021 entitled AN ORDINANCE AMENDING THE ANNUAL BUDGET FOR THE FISCAL YEAR BEGINNING JULY 1, 2020 AND ENDING JUNE 30, 2021, AND AMENDING ORDINANCE 7-2020 TO RECEIVE VARIOUS GRANT FUNDS (TO INCLUDE THE FIRST TRANCHE OF AMERICAN RESCUE PLAN ACT GRANT FUNDS); TO PROVIDE FOR APPROPRIATIONS DUE TO SHORTFALL, PRIMARILY FROM COVID-19 PANDEMIC; THE PURCHASE OF THE LINCOLN STATUE, RECEIVING HALF OF THE COST FROM THE YOUNG FOUNDATION; THE PURCHASE OF REAL ESTATE, ADDITIONAL DEVELOPER ANNEXATION REIMBURSEMENTS AND FOR REVENUE AND EXPENDITURE OF SECONDARY POLICE EMPLOYMENT.
Rationale

Budget amendment to receive various grant funds (to include the first tranche of American Rescue Plan Act grant funds); to provide for appropriations due to shortfall, primarily from COVID-19 pandemic; the purchase of the Lincoln statue receiving half of the cost from the Young Foundation; the purchase of real estate, additional developer annexation reimbursements, and for revenue and expenditure of secondary police employment.

7.A. Consider Municipal Order 23-2021 entitled A MUNICIPAL ORDER AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE A RELEASE OF RESTRICTIVE COVENANTS AND REVERSIONARY CLAUSE FOR PROPERTY LOCATED AT 731 JACKSON STREET.
Rationale

The City conveyed real property located at 731 Jackson Street to The ARC of Owensboro, Inc. (ARC) in 2002. The deed imposed restrictive covenants which required ARC to use the property for job training, rehabilitation and job placement for persons with disabilities, and requiring that if the property were sold, any net sales proceeds would be used in a manner consistent with the Grantee’s charitable mission and Section 501(c)(3) of the Internal Revenue Code, for public use and/or benefit. The deed also contained a reversionary clause in favor of the City in the event ARC ceased to operate the subject property for the uses and purposes set forth above. ARC now desires to sell the real property located at 731 Jackson Street and the restrictive covenants and reversionary clause constitute an impediment to the sale. The City has obtained satisfactory written assurances desires to execute a release of the restrictive covenants and reversionary clause.

Rationale

Members of the audience are invited to address the City Commission on any matter of public concern that was not on tonight’s agenda.  Comments are limited to issues within the scope and responsibility of this Commission.  Commission meetings are held to conduct city business for the benefit of Owensboro citizens and taxpayers. 

At this time, anyone who wishes to address the City Commission please make their way to the podium to be recognized.  Speakers must state their name and address for the Clerk’s record, and limit their remarks to three (3) minutes or less.  Since the item is not on the agenda, no response is required from City staff or the Commission.  The Mayor reserves the right to extend time to the speaker.
