IV.A. Recognition of Fern Creek Traditional High School Marine Corps Junior Reserve Officers Training Corps
Rationale

On January 13, the Fern Creek Traditional High School (FCTHS) Marine Corps Junior Reserve Officers Training Corps (MJROTC) was formally presented with the Marine Corps Reserve Association Outstanding MCJROTC Unit Award, the highest award bestowed upon a MJROTC unit.

This prestigious award is given to an outstanding unit in each of six regions for exemplifying excellence in the competitive categories of student government, school activities, academics, competition teams, and community service. FCTHS MJROTC participated in more than 11,000 hours of community service supporting more than 38 different organizations during the 2010-11 school year. The cadets performed in 30 competitive events, including drill, rifle, and athletics. The MCJROTC Drill Team also won its twelfth consecutive National High School Drill Team Championship title in Daytona, Florida.

This marks the fifth time FCTHS has won the MCJROTC Unit Award and the thirteenth consecutive time for receiving the Naval Honor School designation.

Teachers earn National Board Certification by demonstrating their knowledge and teaching skills through an extensive, rigorous evaluation process. Performance is assessed based on analyses of teaching portfolios, student work samples, and videotaped classroom teachings. Teachers must demonstrate their ability to effectively manage and measure student learning, and they must complete ten assessments that are designed to test the depth of their knowledge and to show that they have mastered the content in their certification area.

Speakers who have registered to address the Board of Education on agenda items will be called when that agenda item is brought forward.

Speakers who have registered to address the Board on non-agenda items are heard after the Board has conducted regular business, near the end of the meeting.

Each speaker is allowed three minutes to address the Board. At the end of 2-1/2 minutes, a bell will sound once. You will then have 30 seconds to finish your statement.  At the end of three minutes, the bell will sound twice, indicating that your time is up.

Rationale

This is a report of field trip requests submitted to the Board of Education for approval on January 23, 2012. Administrative Regulation 702 KAR 5:060 requires that the use of common-carrier field trips be approved and cited in Board of Education minutes.

Also included are other field trips approved by the superintendent per JCPS Policy IICA.

V.D.1. Approval of Project, BG-1 Form, and Assignment of Architect/Engineer for Lower Gym Bleacher Replacement at Atherton High School
Rationale

This project will address the removal of the lower tier of expandable bleachers in the main gymnasium and replace them with power-assisted expandable seating.

Pursuant to the requirements of KRS 322.010 and 323.010, et al. and the policies and procedures of the Jefferson County Public School District, a certified and licensed architect or engineer is assigned to all projects that modify, renovate, or construct additions to existing buildings.

The architect or engineer is responsible for the proper preparation of all plans, specifications, estimates, and direct supervision during the execution of the construction contract. The architect or engineer will supervise the bid process, as required by the district’s Model Procurement Code, and provide an appropriate written recommendation to the district.

The Kentucky Department of Education requires approval of the attached resolution in order to enter into contracts with the design firm of this project. Plans and specifications will be prepared with this approval.

The architect or engineer is responsible for the proper preparation of all plans, specifications, estimates, and direct supervision during the execution of the construction contract. The architect or engineer will supervise the bid process, as required by the district’s Model Procurement Code, and provide an appropriate written recommendation to the district.

This project will provide for upgrading the heating, cooling, and ventilation systems in the school's engineering lab.

On November 22, 2010, the Board of Education approved assigning McCulloch Associates Architects to prepare plans and specifications for Project 164-11014.

On April 25, 2011, the Board approved awarding a contract to Geoghegan Roofing Corporation as the low bidder.

McCulloch Associates Architects has now advised the staff this contract is complete and final payment is due the contractor.

V.M. Approval of the General Fund Draft Budget for Fiscal Year 2012-13
Rationale

The central office cost center budgets for fiscal year 2012-13 are in the process of being reviewed and will be completed in March 2012.
 
Projected student enrollment numbers by school are used to determine the individual school allocations. After the Board approves the enrollment projections, individual school allocations will be determined. Enrollment projections will be presented to the Board for approval in February 2012. Individual site-based allocations are due to schools no later than February 6, 2012.
 
The General Fund Tentative Budget will be presented to the Board in May 2012 as required by KRS 160.470.

V.N. Acceptance of an Offer of Assistance for Annual Debt Service on Bonds
Rationale

The SFCC offering provides for an approximate bond value of $7,200,000. The debt service on the bond would be paid with the SFCC offering. The bond can be sold after July 1, 2012.

Recommended Motion

Superintendent Donna Hargens recommends that the Board of Education accept an offer of assistance from the School Facilities Construction Commission (SFCC) in the amount of $602,483 annual debt service on bonds to be sold for proposed construction or major renovation of facilities outlined in the most current approved facility plan.

V.O. Acceptance of Donations
Rationale

Audubon Traditional Elementary School Parent Teacher Association received a copier valued at $5,000 from Office Ware. The copier will be used for the PTA newsletter, events, etc.

Central High School Magnet Career Academy received $15,000 from Corey Peters. The school received $7,500 to be used for expenses and equipment for the wrestling team; $2,500 to be used for the baseball team uniforms; and $5,000 to be used for all athletic team expenses.

DuPont Manual High School received $1,000 from PharMerica Corporation. The funds will be used for registration fees and travel expenses for the Science Olympiad team competition.

The Family Resource and Youth Services Centers will receive food supplements valued at approximately $2,800,000 from the Kentucky Harvest-Blessings in a Backpack program. This program will serve approximately 35,000 students at $80 per student. The food supplements will be delivered weekly to the schools for the students to take home each weekend.

Farnsley Youth Services Center received $1,000 from the Zoeller Company. The funds will be used to purchase items and supplies for families in need and for the Youth Services Center.

Frost Middle School received $1,000 from LG&E-KU. The funds were used to provide assistance for families for the holiday season.

Goldsmith Elementary School received $1,000 from Martin L. Adams and Sons, Inc. The funds will be used for students’ supplies and general expenses at the school.

Gutermuth Family Resource Center received $3,050. The school received Visa gift cards valued at $650 from Sodexo Corporation and 16 Christmas baskets valued at $2,400 for the 2011 Christmas Basket assistance program.

The JCPS Gheens Academy for Curricular Excellence and Instructional Leadership received 125 new Beanie Babies valued at $600 from Robert Herman. These will be used for student projects for the Spalding University and JCPS partnership.

Maryhurst received $1,000 from the Richard R. Barker Charitable Foundation. The funds will be used to pay the salary of an outside contractor to teach practical living/health and wellness skills.

Nutrition Services received gift cards valued at $750 from ConAgra Foodservice. The fifty $15 gift cards will be used to purchase prizes and incentives for students’ contests.

Portland Elementary School received $1,000 from the BASF Corporation. The funds will be used to enhance the outdoor classroom and environmental programs.

Wellington Family Resource Center received $1,000. The funds will be used to support after-school fitness and educational enhancement programs.

The Youth Performing Arts School received $500 from the Sheeran Howard King Family Fund. The funds will be used for general supplies for staff and students.

Superintendent Donna Hargens recommends that the Board of Education accept donations totaling $2,831,900 to be used as stated in the rationale.

V.P. Acceptance of Funding from the Jefferson County Public Education Foundation
Rationale

Jefferson County Public Schools received funding totaling $122,984.49 from the Jefferson County Public Education Foundation from the following:

  • Gordon Food Service donated $1,693.16 to be used for scholarships for high school seniors.
  • Marsh McLennan donated $750, through two matching gifts from Marcie Gunnell, to be used for the Youth Performing Arts School Percussion Department and the duPont Manual High School Academic Team.
  • Metro Bank donated $1,050 in honor of Stephanie Bateman to be deposited in the unrestricted account.
  • Jim Allen donated $1,000 to be deposited in the unrestricted account.
  • Sam Corbett donated $250 to be deposited in the unrestricted account.
  • Louisville Metro Council donated a total of $4561.33. Funds in the amount of $3,648 will be used for the Adult Education Program; $580 will be used by the Brown School for a field trip to the Louisville Zoo; and $333.33 will be used by Hazelwood Elementary School for the Citizen of the Month program.
  • The Norton Foundation donated $10,000 to be used for programs at Lincoln Elementary School.

Rationale

Approval of this agreement will allow students to receive valuable training in the fields of banking and finance through the Class Act Academy of Business and Finance at Southern High School. Students will receive hands-on training from Class Act employees throughout the summer and during the school year. During the summer months, selected students will be trained as student branch managers at Class Act Corporate headquarters.

At the beginning of school in August, the student branch managers will be responsible for training selected finance students for the positions of teller. The students will manage the day-to-day operations of the credit union with assistance from the Class Act office and the Southern instructor and career specialist. The program ensures focused, relevant, and real-world student learning.

V.T. Approval of Amended Memorandum of Agreement with the University of Louisville for The Academy @ Shawnee Theater Project
Rationale

On June 27, 2011, the Board of Education accepted a grant from the University of Louisville Signature Partnership Initiative in the amount of $50,000 to support The Academy @ Shawnee School Theater Project.  

The original bid for the auditorium sound system was approved on June 27, 2011, and expired on October 1, 2011, before the renovations could begin. The district has rebid and contracted for the auditorium renovations at The Academy @ Shawnee per the specifications outlined in the auditorium bid process. The new bid tabulation for the auditorium sound system for The Academy @ Shawnee was approved by the Board of Education on December 12, 2011.  

On November 7, 2011, the Board of Education approved a Memorandum of Agreement (MOA) with the University of Louisville for the auditorium renovations at The Academy @ Shawnee.

The attached MOA has been amended to reduce the amount of reimbursement from $50,000 to $46,092.00 and to change the date of completion from December 16, 2011, to May 31, 2012.

The work will be supervised by JCPS, and JCPS will submit invoices to the University of Louisville for reimbursement of the project not to exceed $46,092 in two equal installments of $23,046 each. One installment shall be 30 days after the initiation of the work. The second installment shall be 30 days after the completion of the work no later than May 31, 2012. Any balance in excess of $46,092 will be covered by the school.

V.U. Approval of Memorandum of Understanding with Restorative Justice of Louisville, Inc.
Rationale

Restorative Justice Louisville, Inc. (RJL) began as a collaborative of representatives from the criminal justice system, private agencies and the community who are committed to implementing restorative justice practices in Louisville.  The representatives include Jefferson District Court, Jefferson County Attorney, Louisville Metro Public Defender, Louisville Metro Police Department, Kentucky Department of Juvenile Justice, Administrative Office of the Courts, Jefferson County Circuit Court Clerk, Just Solutions, Inc., Peace Education, Clifton Universalist Unitarian Church, Disproportionate Minority Confinement Advisory Board, Jefferson County Public Schools, Louisville Bar Foundation, Louisville Metro Criminal Justice Commission, Louisville Metro Human Relations Commission, Luther Luckett Christian Church, Newburg Ministerial Association, Peace Works, Spalding University, Stoll Keenon Ogden PLLC, and the University of Louisville.

The initial pilot project was implemented in the LMPD Second Division. Plans are proceeding to expand into the First and Fourth Divisions. RJL has worked to implement the use of a restorative justice practice, Family Group Conference (FGC), in lieu of formal Juvenile Court proceedings for cases meeting the eligibility criteria. The process is convened by a trained facilitator and involves the participation of the victim and his/her support person(s), offenders and their family members, law enforcement, and community representatives. Once eligible juveniles are identified, arraigned in Juvenile Court, and referred by the Juvenile Court Judge, the facilitator makes arrangements and works with participants to prepare for the conference. If parties reach agreement, a plan is developed to address the needs of the victim, hold offenders accountable, and involve representatives of the community in the process.  The plan will be submitted to the court for approval or rejection. If the victim refuses to participate, the offender maintains innocence, no agreement is reached or the plan is rejected by the court, the case is returned to Juvenile Court for formal adjudication.

The RJL Executive Committee and Taskforce recommended that RJL establish a process to review the current practices and service coordination for cases involving children ten and under referred to court with criminal offenses. Everyone identified that these cases needed to involve more efficient, effective case/service coordination as opposed to processing these children through the juvenile justice system if possible. The following agencies were identified as being integral to developing the process for this population of children: JCPS, County Attorney’s office, Public Defender, Department of Community Based Services, Seven Counties Services and other service providers and agencies as they are identified. 

The agencies identified a pilot process for these youth with an emphasis on age appropriate assessments for these children and assessments for their families with the development of comprehensive service plans involving all the appropriate agencies (see attached). It has been noted that these families have shown resistance to involvement with the appropriate agencies and services to assist in addressing the needs of their children. With the referral to RJL as a diversion from juvenile court, trained facilitators will implement the process model developed for RJL to develop an agreement committing the family to seek that appropriate assessment and services for the child and family. 

To assist in implement this pilot processes, the memorandum of agreement is being implemented to assist in the sharing of appropriate information related to these children and families.

On September 26, 2011, the Board of Education approved a Professional Services Contract with Phi Delta Kappa International to conduct an audit of the quality of the system’s curriculum management process. 

As stated in the book entitled The Curriculum Management Audit by Larry E. Frase, Fenwick W. English, and William K. Poston, Jr., “The curriculum management audit focuses like a laser on that which schools should be all about—learning. The audit is designed to determine the degree to which the written, taught, and tested curricula are aligned and the extent to which all district resources are organized to support development and delivery of the curricula.”

Dr. John Murdoch has completed the audit and will present the results.
