IV.A. Recognition of Diya Mathur
Rationale

Diya Mathur is one of 150 students from a pool of 2,977 from across the nation who was selected and received a $1,000 MathMovesU scholarship for her creative multimedia presentation that illustrated the importance of math in her daily life. The scholarship can be used for college or for a math, science, or technology camp. Her school also received a $1,000 matching grant to be used for mathematics-related programs.

The MathMovesU initiative was implemented in 2005 by Raytheon Company to inspire enthusiastic participation and interest of middle school students in mathematics. The initiative is an education-based program designed to combine learning mathematics with fun, interactive games and activities online and to understand the relationships of mathematics to real-world applications.

Raytheon Company is a national technology leader specializing in defense, homeland security, and other government markets around the world.

Recommended Motion

Superintendent Donna Hargens recommends that the Board of Education receive a recognition of Diya Mathur, a student at Meyzeek Middle School, as a national MathMovesU Scholarship winner.

IV.B. Recognition of the District's Family, Career, and Community Leaders of America State and National Leadership Conference Students Taking Action with Recognition Event Winners
Rationale

Ieshia Irvin, Lauren Quaife, and Darion Taylor; students at Waggener High School; participated in and won at the Family, Career, and Community Leaders of America (FCCLA) state level, which qualified them to compete in the 2011 National FCCLA Students Taking Action with Recognition (STAR) Events competition.

More than 3,500 students competed in the national competition, which builds leadership and job readiness skills. The FCCLA National Leadership Conference was held in Anaheim, California, on July 10 through 14. Ieshia and Lauren both received Bronze medals in the Culinary Arts division of the competition.

The national conference theme was “Imagination in Action.” Students competed in 28 STAR events. Each winning participant received medals, certificates, and recognition in their local communities via the media.

FCCLA is a national student organization that encourages and helps our young people to become leaders and to develop life skills through Family and Consumer Sciences Education.

IV.C. Recognition of Jefferson County Public School District Students
Rationale

Seven JCPS students have been selected as Congressional Medal of Honor Outreach Essay and Art Scholarship program finalists. District students, along with three other Kentucky high school students, were formally recognized on August 19 at the Frazier History Museum in Louisville. These ten student finalists received a total of $30,000 in scholarship awards. The top Essay and Art finalist received a $5,000 scholarship and certificate, and the other finalists received a $2,500 scholarship and certificate.

Courtney Brewer, a student at Fern Creek Traditional High School, and Arthur Clemens, a student at Eastern High School, were selected as Essay Finalists. Amy Hoagland, a student at Louisville Male High School; Jacob Jury, Sara  Katz, and Samantha Kimura, students at Ballard High School; and Kendall Lawton, a student at Jeffersontown High School; were selected as Art Finalists.

More than 375 students submitted entries that represented themes of courage, selflessness, sacrifice, responsible citizenship, and patriotism. The award-winning entries were selected from each category based on who best expressed the exemplary values of the Medal of Honor.

The Congressional Medal of Honor was created in 1861 by Congress and was bestowed by the President of the United States. The award is the nation’s most prestigious and highest honor given for valor in combat.

IV.D. Recognition of Ashley Lamb-Sinclair
Rationale

Ashley Lamb-Sinclair, language arts and drama teacher at Myers Middle School, received a scholarship from the English Speaking Union of the United States to attend Oxford University in England to study creative writing this summer. She also received a free week's stay in London before her study began, which gave her the opportunity to travel and gather materials for future classroom use.

Ashley is one of 16 Fulbright-Hays Scholarship recipients and the only Kentucky teacher selected to participate in this prestigious program. In honor of her outstanding achievement, she travelled throughout Thailand and Vietnam. She attended a three-day predeparture conference in the United States and visited Asia from June 12 through July 18. She also participated in cultural studies during home visits, toured sites not open to tourists, and attended various presentations. During her visit, she also spent time in classrooms and studied the differences in the educational systems.

Superintendent Donna Hargens recommends that the Board of Education receive a recognition of Ashley Lamb-Sinclair, teacher at Myers Middle School, for receiving a scholarship from the English Speaking Union of the United States and for receiving a Fulbright-Hays Scholarship.

IV.E. Recognition of Pleasure Ridge Park High School Teachers
Rationale

On August 17, Cody Aikins, a student at Pleasure Ridge Park (PRP) High School, collapsed outside in the courtyard. Another student witnessed what happened and ran inside the school to Megan Miller’s room to get help. The student informed Miller what happened and that she needed to get to the courtyard.

Rich Hawks, another teacher, also accompanied Miller to the site outside where Cody was lying on the ground. The teachers saw that Cody was gasping for breath and in a seizure-like state. Moments later, Cody lost consciousness and stopped breathing. The teachers began to give the student CPR for approximately ten minutes, at which time Derek Mattingly stepped in and started giving the student CPR for approximately five more minutes when he noticed that his colleagues began to tire. Shortly thereafter, Emergency Medical Technicians arrived at the site to take over treatment of Cody and transport him to the hospital.

The Jefferson County Board of Education extends its sincere gratitude to Megan Miller, Rich Hawks, and Derek Mattingly for their heroic actions in saving the life of Cody Aikins.

Rationale

V.D. Approval of Bid and Revised BG-1 Form for 2011-12 Asbestos and Lead Abatement Maintenance Contract at Various Schools
Rationale

This project is a contract for the removal of incidental asbestos and lead as it relates to found conditions in minor construction projects. The contract will expire on September 11, 2012, unless renewed by both parties for an additional one-year term.
 
On May 23, 2011, the Board of Education approved assigning Environmental Concerns, Inc. to prepare plans and specifications for Project 11040-VAR.
                                             
The price contract is required in order to comply with the school district’s Asbestos Hazard Emergency Response Act (AHERA) management plans. Compliance with the management plans began on July 9, 1989.
 
Bids were received, publicly opened, and read aloud in the Office of Facilities/Transportation on August 30, 2011. The bid tabulation is attached.
 
This item requests approval to award contracts to the low bidders of facility construction projects and reject bids deemed unacceptable in accordance with KRS 160:070.

V.H. Approval of Architect/Engineer Assignments for 2012 Capital Construction Projects at Various Schools
Rationale

Pursuant to the requirements of KRS 322.010 and 323.010, et al., and the policies and procedures of the Jefferson County Public School District, a certified and licensed architect or engineer is assigned to all projects that modify, renovate, or construct additions to existing buildings.

The architect or engineer is responsible for the proper preparation of all plans, specifications, estimates, and direct supervision during the execution of the construction contract. The architect or engineer will supervise the bid process, as required by the district’s Model Procurement Code, and provide an appropriate written recommendation to the district.

The Kentucky Department of Education requires approval of the attached resolution in order to enter into contracts with the design firms of these projects. Plans and specifications will be prepared with this approval.

V.O. Approval of Amendment to the Administrative Services Agreement
Rationale

In 2009–10 and 2010–11, the rate for Wrongful Acts claims was $625 and the rate for General Liability claims was $325.

Beginning July 1, 2011, the rate for Wrongful Acts increased to $650 and the rate for General Liability increased to $425. All other rates in the agreement remain unchanged.

This agreement sets the duties, services, and payment terms for the administration of the district's general liability/educators legal liability claims.

Superintendent Donna Hargens recommends that the Board of Education approve the rates for the amended Administrative Services Agreement for the General Liability/ Educators Legal Liability Insurance Program and authorize the superintendent to sign the necessary agreement.

V.P. Acceptance of Disclosure of Free and Reduced Price Information Agreement
Rationale

JCPS School and Community Nutrition Services and Jefferson County Public Schools acknowledge and agree that children’s free and reduced price meal and free milk eligibility information obtained under provisions of the National School Lunch Act (42 USC 1751 et. seq.) or Child Nutrition Act of 1966 (42 USC 1771 et. seq.) and the regulations implementing these Acts is confidential information. 

This Agreement is intended to ensure that any information disclosed by Nutrition Services to Jefferson County Public Schools about children eligible for free and reduced price meals or free milk will be used only for purposes specified in this Agreement, and that Nutrition Services and Jefferson County Public Schools recognize there are penalties for unauthorized disclosures of the eligibility information. 
 
This action shall be effective from October 1, 2011, until September 30, 2012. An annual review and approval is required by federal regulations.

Superintendent Donna Hargens recommends that the Board of Education approve the 2011–12 Disclosure of Free and Reduced Price Information Agreement.

V.Q. Approval of the Indirect Cost Rate for Fiscal Year 2011–12
Rationale

Indirect costs are expenditures in support of a program that are not directly identifiable to that program. The Kentucky Department of Education (KDE) calculates the allowable percentage that may be applied to grants so the district may be reimbursed for a portion of the support expenses incurred.

The non-restricted Indirect Cost rate of 14.72 percent can be applied to food service and the restricted Indirect Cost rate of 3.61 percent is for use with grants. Each local Board of Education is encouraged to approve the rates prior to October 1, which is the beginning of the federal fiscal year.

If the rate is not approved by October 1, the district cannot apply the rate at a later time during the fiscal year. If the Board adopts the rates, they are not obligated to apply the Indirect Cost rates.

The JCPS Gheens Academy for Curricular Excellence and Instructional Leadership received six grand pianos and two upright pianos valued at $1,500 from the University of Louisville School of Music. The pianos will be used in schools for student performances and instruction.
 
Olmsted Academy North received acoustic panels valued at $4,000 from Acoustic Solutions. The panels will be mounted on the walls of the band room.
 
The Student Assignment, Health, and Safety Department of Community Information received $2,000 from the ING Unsung Heroes Awards Program. The funds will be used to purchase a Leap Pad reading system that will be used to enhance the after-school literacy efforts of the 21st Century Community Learning Centers program site at Semple Elementary School.
 
The Youth Performing Arts School received $2,500. They received $500 from the Kentucky Fair Board to be used for expenses for the production season and $2,000 from Republic Bank to be used to sponsor their upcoming musical, The Wedding Singer.

The Youth Performing Arts School Percussion Department received a matching gift of $1,000 from David Metz.

Rationale

The Kentucky Department of Education has awarded the district $156,847 as continuing support for the district's gifted and talented education program.  The award is for the provision of program services during the 2011–12 school year.

Examples of the services that the district provides through the grant to support primary talent pool development and formally identified gifted and talented student are as follows:

  • Professional development for district teachers;  
  • Implementation of curriculum development in the areas of gifted and talented methodologies and teaching strategies;
  • Instructional materials and supplies;
  • Implementation of the state-mandated Gifted and Talented Student Services Plan and Gifted Student Progress Report for children enrolled in the Jefferson County Public Schools Advance Program; and 
  • Support for a summer enrichment program, Project REACH, that prepares formally identified minority students for participation in the district's Advance Program in grades P4 through 8. 

All activities and expenditures are in compliance with state requirements.

V.X. Approval to Name the Basketball Floor of Louisville Male High School the Ralph Beard Court
Rationale

Louisville Male High School (Male) was founded in 1856 and is the oldest school in the Jefferson County Public Schools (JCPS) District. Throughout the school's history, extracurricular activities have been an integral part of its educational mission. The school is also supported by an active alumni association, whose mission is to improve the educational and extra-curricular experience for all of its students.

The gymnasium at Male is currently named the Pap Glenn Gym. In an effort to preserve the rich history and tradition of Male High School, that name will remain unchanged. However, the school requests permission to name the basketball floor Ralph Beard Court in honor of one of its legendary student athletes.

Ralph Beard was a High School All-American, captain of the 1945 Male State Championship team, and a graduate of the Class of 1945. Upon his graduation, Beard became a member of the University of Kentucky men's basketball team known as the Fabulous Five, who played for legendary coach Adolph Rupp. Beard won two National Collegiate Athletic Association (NCAA) National Championships and three times was named as an NCAA First Team All-American. In 1948, Beard won a gold medal as part of the United States basketball team at the Summer Olympics. 

The naming of the basketball floor is a fitting tribute and honor to Ralph Beard's many accomplishments and his love for Louisville Male High School.

Therefore in accordance with JCPS policy and procedure, it is appropriate that the basketball floor at Louisville Male High School be named Ralph Beard Court.

V.Y. Approval to Name the Football/Track Facility at Louisville Male High School the Veterans Memorial Stadium
Rationale

Louisville Male High School (Male) was founded in 1856 and is the oldest school in the Jefferson County Public School (JCPS) District. As a traditional school, it educates and encourages civic responsibility and service among its students, faculty, and alumni. The school is also supported by an active alumni association, whose mission  is to improve the educational experience for all its students.

Over the last 155 years, thousands of Male graduates have served in the United States Armed Forces, and hundreds of Male alumni have given their lives to safeguard the freedom and liberty that we enjoy in the United States of America.

The football field is currently named Maxwell Field and the track is currently named John Conn Track pursuant to earlier designations by the Board of Education. In an effort to preserve the rich history and tradition of Male High School, those names remain unchanged.

The naming of the football/track facility as Veterans Memorial Stadium is a fitting tribute and honor to the many Male alumni who served our country.

Therefore, in accordance with Board of Education Policy FF Naming Facilities and related procedures, it is appropriate that the football/track facility at Louisville Male High School be named Veterans Memorial Stadium.

V.Z. Approval of 2012 Grant Application for Purchase of 18 Hybrid Electric 66-Passenger School Buses to Replace Aging Fleet Inventory
Rationale

The 2012 School Bus Purchase Authorization from the Kentucky Department of Education and Workforce Development Cabinet, Division of District Support, will allow the district to participate in the state contract bid for school buses. The buses recommended for purchase are to replace aging fleet inventory and will be part of our normal bus replacement program cycle.
 
The purchase will be partially funded via reimbursement through a U.S. Department of Energy grant awarded to the Kentucky Education Cabinet. This grant reimbursement is estimated to be $1,153,638. This is based on the difference in cost between the non-hybrid Cummins ISB Freightliner and the cost of the hybrid electric buses. Each district must submit a proposal, including number of units, to the Kentucky Education Cabinet for review and award of a sub-grant for the hybrid bus purchase.
 
Data collected from these hybrid buses will be shared with KDE for the purpose of evaluating hybrid bus performance throughout the Commonwealth of Kentucky.

Should the district’s proposal be declined, regular 66-passenger 2012 standard school buses will be purchased instead.

The project shall provide for the complete renovation of the swimming pool, its attendant systems and support structure.

Pursuant to the requirements of KRS 322.010 and 323.010, et al. and the policies and procedures of the Jefferson County Public School District, a certified and licensed architect or engineer is assigned to all projects that modify, renovate, or construct additions to existing buildings.

The architect or engineer is responsible for the proper preparation of all plans, specifications, estimates, and direct supervision during the execution of the construction contract. The architect or engineer will supervise the bid process, as required by the district’s Model Procurement Code, and provide an appropriate written recommendation to the district.

The Kentucky Department of Education requires approval of the attached resolution in order to enter into contracts with the design firm of this project. Plans and specifications will be prepared with this approval.
