IV. Recognitions and Resolutions
Rationale

Recognition of the Poplar Level Area Business Association, the Rubbertown Business Association, and the Third Street Neighborhood Association


Cane Run Elementary School, Cochran Elementary School, and Rangeland Elementary School benefitted from the enormous efforts and generous contributions from three Louisville area business associations—in partnership with other community organizations, leaders, and officials—to build new, state-of-the-art playgrounds for the schools.

The Rubbertown Business Association received a gift of $25,000 from Metro Councilwoman Mary Woolridge and, to date, have raised a total of $180,000 to build Cane Run Elementary’s handicap-accessible playground. The Third Street Neighborhood Association donated $75,000 to Cochran Elementary School to construct its playground, which is handicap-accessible and wheelchair-friendly. The Poplar Level Area Business Association kicked off a fundraising effort and through this effort received a gift from Metro Councilwoman Barbara Shanklin for $40,000. The association secured another $15,000 to build Rangeland Elementary School’s playground, which is completed and is now being used.

The district extends its sincere appreciation to these business partners for helping to enhance the well-being and learning of JCPS students.

Rationale

Pursuant to KRS 160.380, it is my responsibility to report to the Board of Education routine personnel actions that I have taken that affect certified and classified employment.

V.C. Approval of Organizational Chart
Rationale

The Business Partnerships and Resource Development organizational chart is submitted to recommend that the funding source of three Coordinators I be moved from categorical funding to general funding. This change is necessary to align with the district budget. A descriptor is included for the Coordinator School Business Partnerships to designate connection of the position to Greater Louisville, Inc.  The Volunteer Talent Center will move from the Director Resource Development to a Specialist I in the department. The request includes a change in reporting relationship of one clerk from the Director Resource Development to the Specialist I.

Rationale

V.F.1. Approval of Bid and Revised BG-1 Form for Renovation Phase 1, Asbestos Abatement Package A, at Blue Lick Elementary School
Rationale

This project consists of the removal of asbestos lay-in ceiling tiles from Rooms 101, 102, 104-114, Lounge, Art Room, and Reading Room for Project 091-9037. Removal will be conducted in four phases.

On September 13, 2010, the Board of Education approved assigning Environmental Concerns to prepare plans and specifications for this project.
                                             
The Kentucky Department of Education, Division of Facilities Management, reviewed the Application for a Building Project, plans, and specifications and approved the taking of bids.
 
Bids were received, publicly opened, and read aloud in the Office of Facilities/Transportation on November 9, 2010. The bid tabulation is attached.

On October 12, 2009, the Board of Education approved assigning Luckett & Farley to prepare plans and specifications for this project. On March 22, 2010, the Board approved awarding a contract to ShelCon Construction in the amount of $375,070 for Package A-Switchgear Replacement; and on May 24, 2010, the Board approved awarding a contract to E.H. Construction Co. in the amount of $71,700 for Package B-Demolition of the Healing Place Building.

The Kentucky Department of Education, Division of Facilities Management, reviewed the Application for a Building Project, plans, and specifications and approved the taking of bids.

Bids were received, publicly opened, and read aloud in the office of Facilities/Transportation on November 9, 2010. The bid tabulation is attached.

V.N. Revision of Model Procurement Regulations
Rationale

The Kentucky Model Procurement Code contains specific provisions, KRS 45A.345 - 45A.460, which may be adopted by local public agencies, including local boards of education. The code provides that no other statutes governing purchasing shall apply to the local public agency upon adoption of such provisions. The local public agency provisions of the code have been effective within the Jefferson County School District since 1980.

The attached revision incorporates changes to the code, which will allow the Board to award multiple, partial, and progressive contracts as provided for in KRS 45A, Kentucky Model Procurement Code, Section 45A.360(h) when such awards are in the best interest of the Board. The revision also updates the code to reflect the requirements of KRS 45A.494(2) used for determination of bidder residency status when awarding contracts.

In the system of revision used in the attached regulations, words and punctuation in red with a strike-through are proposed deletions, while words and punctuation in blue are proposed additions and corrections to the regulations.

The Kentucky Department of Education has awarded the district’s Volunteer Talent Center a $5,500 grant for Learn and Serve, which will fund service learning programs at Thomas Jefferson Middle School and a second middle school yet to be chosen. 
 
Each middle school will receive $1,000 for students to develop and implement two or three service projects that are linked to the Creating a Respectful Environment (CARE) for Kids curriculum. The remaining funds of $3,500 will be used for bus transportation, teacher training stipends, project resource materials, and evaluations.

The Kentucky Department of Education, through the No-Child Left Behind, Title II, Part D, non-competitive appropriation, has awarded the District $125,105 to fund education technology programs at district schools. This program provides funds for innovative initiatives that support the integration of education technology into classrooms to improve teaching and learning.

Grant funds will provide professional development and hardware and software.  The funding period is July 1, 2010, through September 30, 2012. Title II, Part D, funds may benefit all JCPS students and teachers.

V.P.4. Acceptance of Grant Funds For 21st Century Community Learning Centers
Rationale

The Kentucky Department of Education has awarded the district $438,144 to fund continuations of 21st Century Community Schools at Okolona, Shelby, and Semple elementary schools, and Thomas Jefferson Middle School. 
 
The funds are targeted to students with scores above the second stanine, but who also do not function solidly at grade level. This group of students forms a substantial portion of the children at the schools.
 
The project combines proven, researched, methods for increasing academic achievement through a structured, adaptable system and incorporates enrichment activities guided by the Kentucky Core Curriculum that will improve the in-school performance of a group of children at risk of being left behind.
 
The Centers will expend awarded funds to provide two academic support strategies that will improve, to proficiency, the academic achievement of students scoring at grade level or below.
 
The two strategies include a computer–based reading program that uses literature-based activities to focus on phonics, vocabulary, comprehension, and writing; and one-to-one tutoring offered by high school and college students in service learning, college students in the Federal Work Study program, and adult volunteers.

V.Q. Approval of 2011 Purchase of School Buses for Regular and Special-Needs Student Transportation
Rationale

The 2011 School Bus Purchase Authorization from the Kentucky Department of Education, Education and Workforce Development Cabinet, Division of District Support, will allow the district to participate in the state contract bid for school buses. Funds are from two sources—$740,000 from Title I American Recovery and Reinvestment Act (ARRA) stimulus funds and the remainder from the JCPS 2010–11 School Bus Replacement Account.

The bus purchase will comprise five (5) 52-passenger ECE buses with wheelchair lifts and air conditioning, sixteen (16) 52-passenger ECE buses with air conditioning, and twenty-six (26) regular 66-passenger buses.

The buses recommended for purchase are to replace aging fleet inventory and will be part of our normal bus replacement program cycle.

Rationale

On August 9, 2010, the Board of Education approved the Goals and Strategies for the 2010–11 school year. These goals and strategies are designed to put into practice the district’s Theory of Action. 

After Board approval, the superintendent and cabinet engaged their staff in formulating detailed series of action steps, including timelines and personnel responsible, to implement each of the strategies. In addition, district staff will regularly assess progress on implementing strategies and the impact of those strategies by using performance metrics to determine if our goals were achieved.   
 
The final document—which includes goals, strategies, and action steps—serves as the 2010–11 Comprehensive District Improvement Plan. Public feedback was gathered by placing the document on the web, distributing it to all of our principals, and meeting with parent advisory committees.

XI.A. Interim Evaluation of Superintendent Sheldon Berman
Rationale

The most important duty of the Jefferson County Board of Education is to choose and support a Superintendent who will lead a successful school system that prepares all students for post-secondary education and careers. Since Dr. Sheldon Berman’s  four-year contract will expire on June 30, 2011,  the Board met to conduct an interim evaluation of his performance. 

During this interim session, the Board reviewed past evaluations of the superintendent, student performance progress under his leadership, as well as management and operations issues. The Board has determined that it will not renew his contract and will declare a vacancy and begin the search for a new superintendent. 

As a Board, we wish to refocus our energies on making substantial progress in student achievement at every level. We have been concerned with the stagnant growth in the key areas of reading and math.  Without excellence in these basics, our students will not grasp the criticial knowledge and skills necessary to be successful in a 21st century economy. 

We appreciate Dr. Berman’s commitment to preserving our value of diversity and inclusion within all schools, and for his work in designing a plan to meet that goal. We embrace this value, but recognize we need to take a deep look at the current plan, and if necessary make changes to meet families’ concerns and to shore up community support. 

We want to reassure every staff member, our civic and philanthropic partners, and the community at large, that we will move ahead with the cooperation of Dr. Berman and the leadership of our excellent administrative and school staffs. We know schools will continue during this transition period, focusing their attention where it should always be—on the children of Jefferson County and on their success in our schools.
