Executive Session: Proposed and Pending Litigation
I. Call to Order
Rationale

Portions of this meeting will be closed to the public pursuant to KRS 61.810 (1)(c) of the Kentucky Open Meetings Act

The Regular Meeting will be held at 6:00 p.m. as scheduled. These meetings will be conducted via video-teleconference pursuant to KRS 61.823 and KRS 61.826. The primary location for these meetings and where all members can be seen and heard by the public will be Stewart Auditorium, VanHoose Education Center. Members are permitted to attend in-person or via video-teleconference pursuant to KRS 61.826. II. Enter into Executive Session per KRS 61.810(1)(c) of the Kentucky Open Meetings Act
Rationale

The purpose of this Executive Session is for Board members to have discussions regarding pending and proposed litigation as permitted by KRS 61.810(1)(c) of the Kentucky Open Meetings Act.

Actions Taken

Order #2022-203 - Motion Passed:  A motion to enter into Executive Session as permitted by KRS 61.810(1)(c), for the purpose of a discussion relating to pending and proposed litigation passed with a motion by Dr. Christopher Kolb and a second by Mr. James Craig.

III. Adjourn from Executive Session

Order #2022-204 - Motion Passed:  A motion to adjourn Executive Session and return to open session passed with a motion by Ms. Sarah McIntosh and a second by Mr. James Craig.

IV. Possible Consideration of a Motion on Pending and/or Proposed Litigation
Actions Taken

Order #2022-205 - Motion Passed:  A motion to authorize Board counsel to effectuate a settlement in the matter identified in closed session and pursuant to the terms discussed in closed session passed with a motion by Mr. James Craig and a second by Ms. Sarah McIntosh.

Order #2022-206 - Motion Passed:  A motion to authorize Board counsel to proceed with the filing of an appeal in the matter identified in closed session and pursuant to the facts discussed in closed session passed with a motion by Mr. James Craig and a second by Mrs. Linda Duncan.

Order #2022-207 - Motion Passed:  A motion was made to authorize Board counsel to proceed with the joint filing of a Complaint with the Council for Better Education pursuant to the following resolution: IT IS HEREBY RESOLVED that the Jefferson County Board of Education authorizes Superintendent Pollio and legal counsel to take all necessary steps to support the Council for Better Education, Inc. ("CBE"), in its legal challenge to the unconstitutionality of House Bill 9, including serving as a co-plaintiff, and the payment of any appropriate dues or assessments related to this school district's membership in CBE or its support of the referenced legal challenge. The motion passed with a motion by Mr. James Craig and a second by Ms. Sarah McIntosh.
