Executive Session: Litigation
I. Call to Order
Rationale

This meeting will be conducted via video-teleconference pursuant to KRS 61.823 and KRS 61.826. The primary location for this meeting and where all members can be seen and heard by the public will be Stewart Auditorium, VanHoose Education Center. Members are permitted to attend in-person or via video-teleconference pursuant to KRS 61.826. Members of the public may attend in-person or watch the live-stream of the meeting via the following link: JCBE MEETING VIDEO.

Rationale

The purpose of this meeting is for Board members to have discussions relating to proposed litigation. Portions of the meeting will be closed to the public as provided for under KRS 61.810(1)(c) of the Kentucky Open Meetings Act.

Actions Taken

Order #2022-56 - Motion Passed:  A motion that the Board of Education enter executive session to have discussions relating to proposed litigation per KRS 61.810(1)(c) of the Kentucky Open Meetings Act passed with a motion by Ms. Sarah McIntosh and a second by Dr. Corrie Shull.

III. Adjourn from Executive Session
Actions Taken

Order #2022-57 - Motion Passed:  A motion that the Board of Education adjourn executive session and return to open session passed with a motion by Mr. James Craig and a second by Ms. Sarah McIntosh.

IV. Possible Consideration of Motion Regarding Proposed Litigation
Actions Taken

Order #2022-58 - Motion Passed:  A motion that the Board of Education authorize general counsel to engage outside counsel to proceed with initiating litigation in the filing of a complaint consistent with the matter of proposed litigation discussed in closed session. The identity of the matter cannot be disclosed at this time in order to preserve litigation strategy but will become public at the time of filing with the court. The motion passed with a motion by Mr. James Craig and a second by Ms. Sarah McIntosh.
