Teachers earn National Board Certification by demonstrating their knowledge and teaching skills through an extensive, yearlong evaluation process. Performance is assessed based on analyses of teaching portfolios, student work samples, and videotaped classroom teaching. Teachers must demonstrate their ability to effectively manage and measure student learning, and they must complete a two-part, assessment process that is designed to test the depth of their knowledge.

Recommended Motion

Superintendent Sheldon Berman recommends that the Board of Education recognize the 25 outstanding JCPS teachers have earned National Board Certification.

IV.B. Recognition of the Jefferson County Board of Education
Rationale

Our state, along with others throughout the nation, celebrates the outstanding leadership and dedication of its local school board members. Their efforts help ensure a successful learning environment for all students. They work collaboratively with businesses, organizations, and other community members to bring programs into schools that will enhance the educational experience of students.

School board members are advocates for students. They work diligently to encourage parents and other members of the community to continually be involved in helping to guarantee a successful education for all young people.

Recommended Motion

Superintendent Sheldon Berman recommends that the Board of Education receive a special recognition from Joe Tolan, president of Metro United Way, in honor of National School Board Recognition Month.

V.A. Approval of Personnel Actions
Rationale

Pursuant to KRS 160.380, it is my responsibility to report to the Board of Education the routine personnel actions that I have taken that affect certified and classified employment. 

These actions have been executed in compliance with all Board of Education polices and state and federal laws. All positions are Board of Education approved positions. 

Recommended Motion

Superintendent Sheldon Berman recommends that the Board of Education receive this report of the personnel actions that he has taken per KRS 160.380.

V.B. Approval of Certified Leaves of Absence
Rationale

Pursuant to Kentucky Revised Statues, leaves of absence must be recommended by the superintendent and approved by the Board of Education. The following personnel actions are in compliance with federal and state laws and Board policy regarding equal employment opportunities.

V.C. Approval of Field Trip Requests
Rationale

Administrative Regulation 702 KAR 5:060 requires that the use of common-carrier field trips be approved and cited in Board of Education minutes. Also included is a report of other field trips approved by the superintendent per JCPS Policy IICA. 

Recommended Motion

Superintendent Sheldon Berman recommends that the Board of Education approve the attached requests for field trips and receive a report of other field trips approved by the superintendent.

Pursuant to the requirements of KRS 322.010 and 323.010, et al., and the policies and procedures of the Jefferson County Public School District, a certified and licensed architect or engineer is assigned to all projects that modify, renovate, or construct additions to existing buildings.

The architect or engineer is responsible for the proper preparation of all plans, specifications, estimates, and direct supervision during the execution of the construction contract. The architect or engineer will supervise the bid process, as required by the district’s Model Procurement Code, and provide an appropriate written recommendation to the district. 

The Kentucky Department of Education requires approval of the attached resolutions in order to enter into contracts with the design firms of these projects. Plans and specifications will be prepared with this approval. [KRS 160.290]

V.K. Approval of the Financial Report for the Period ended October 31, 2009
Rationale

This report fairly represents the financial activity of the Jefferson County Public School District through October 31, 2009, and is being submitted to the Board of Education pursuant to KRS 160.560 and JCPS Policy DI: Fiscal Accounting and Reporting. These checks have been issued pursuant to Board approval on May 11, 2009, Payment of Salaries and Claims for fiscal year 2009–10. 

The report includes the following funds: General, Special Revenue, Capital Outlay, Building, Construction, Debt Service, Food Service, Day Care Operations, Adult Education, Tuition Preschool and Trust and Agency.

Recommended Motion

Superintendent Sheldon Berman recommends that the Board of Education approve the financial report for the period ended October 31, 2009.

V.L. Approval of a Water Easement at Southern High School
Rationale

Pursuant to the policies and procedures of the Jefferson County Public School District and in compliance with a formal request from the Louisville Water Company, it is recommended that the easement be granted.

Approval of this recommendation will allow JCPS to comply with a formal request
from the Louisville Water Company for a water easements at Southern High School and authorize the superintendent, or his designee, to sign the necessary documents to implement the easement request. [KRS 162.010]

Recommended Motion

Superintendent Sheldon Berman recommends that the Board of Education grant a water easement, as shown on the attached plat, to the Louisville Water Company for Southern High School, 8620 Preston Highway, Louisville, Kentucky, 40219.

V.M. Acceptance of Donations
Rationale

This item recommends acceptance of donations for $20,979 from various donors for the following school programs:

Activities/Athletics received $2,500 from Class Act Federal Credit Union. The funds will be used to purchase refreshments, shirts, and awards for the students at the schools that participated in the 2009 Class Act Fall Academic tournaments.

Atherton High School received $1,000. The school received $500 from Bruce and Sheree Moorea and $500 from Theodore T. Myre. The funds will be used for repairs on the baseball field.

Gutermuth Elementary School Family Resource Center received $6,600. The school received 300 passes from Kosair Charities for the Belle of Louisville, valued at $2,400, to be used for a private party for the Gutermuth Elementary families. The school received a $1,500 shopping card from Meijer’s to purchase toys for 150 children and $2,700 from Dant Clayton Corporation for 18 holiday baskets to be used for the holiday basket program.

Lassiter Middle School received $500 from Safari Club International to be used to purchase archery equipment.

Mill Creek Elementary School received $4,000 from OfficeWare to be used to purchase a copier for the office.

Pleasure Ridge Park High School received $2,000 from Dr. Thomas V. Jacques, American Chiropractic, to be used to sponsor a basketball tournament.

Portland Elementary School received $879 from Louisville Third Century, John Muzic. The funds will be used to purchase a SMART Board.

Stopher Elementary School received $2,000 from Dale Skaggs to be used to purchase either technology or health and fitness equipment.

Waggener Traditional High School Youth Services Center received $1,500 from the GE Employees Community Fund to be used to purchase uniforms, clothing, and school supplies for low-income students and families.

Recommended Motion

Superintendent Sheldon Berman recommends that the Board of Education accept donations totaling $20,979.

V.N. Acceptance of Grants and Funding
V.N.1. Acceptance of Funding from the University of Louisville Research Foundation, Inc.
Rationale

This item recommends acceptance of a $6,100 subaward from the University of Louisville Research Foundation to be used to provide positive relationship skills training for up to 100 participants in the Youth Opportunities Unlimited (YOU) Program. The project is in the fourth year of a five-year project funded by the U.S. of Department of Health and Human Services. This is continuation funding; no additional staff will be needed.

Recommended Motion

Superintendent Sheldon Berman recommends that the Board of Education accept a subaward in the amount of $6,100 from the University of Louisville Research Foundation, Inc. for the Adult and Continuing Education Unit and further recommends that the board authorize the superintendent to sign the attached agreement.

V.N.2. Acceptance of Grant from the American Association of School Administrators
Rationale

The American Association of School Administrators (AASA) has awarded the Jefferson County Public Schools District one-time funding assistance in the amount of $2,500 for Blessings in a Backpack, an established project that provides food for students in need at Atkinson and Semple elementary schools.

On Fridays, these students will be provided with a special backpack filled with foodstuffs that can help families feed their children. This grant will help maintain this program.

Recommended Motion

Superintendent Sheldon Berman recommends that the Board of Education approve acceptance of this grant in the amount of $2,500 from the American Association of School Administrators (AASA) to provide funding for the Blessings in a Backpack program.

V.N.3. Acceptance of Funding from Louisville Metro Government for Neighborhood Place
Rationale

Louisville Metro Government and Jefferson County Public Schools (JCPS) jointly fund several programs operated within the district that benefit students and families in Jefferson County. Neighborhood Place is a collaboration of Louisville Metro Government, Louisville Metro Health Department, Kentucky Department of Human Services, Seven Counties, and JCPS.

Neighborhood Place is the joint location of staff from the above agencies that provide basic human services to families in a one-stop location that improves convenience and efficiency of services. Neighborhood Place is the primary referral point for families served by Family Resource and Youth Service Centers when families have multiple needs or needs beyond those provided by these Centers.

The services provided are consistent with the provisions of the Kentucky Education Reform Act (KERA) to remove barriers to student achievement. This action allows the district to bill Louisville Metro Government for this program and receive the appropriate funding. 

If this recommendation is accepted, the district will receive funding from Louisville Metro Government in the amount of $84,000 to assist in the operation of the Neighborhood Place program. Due to budget cuts by State and Louisville Metro Governments, this is a reduction in funding from the original $100,000 already agreed to in August 2009. 

Recommended Motion

Superintendent Sheldon Berman recommends that the Board of Education accept funding in the amount of $84,000 from Louisville Metro Government to assist in the operation of the Neighborhood Place program and further recommends that the board authorize the superintendent to sign revised agreements associated with this funding.

V.N.4. Acceptance of Grants from Fund for the Arts
Rationale

The Fund for the Arts has awarded three grants totaling $3,032.75 to fund art projects at the following schools: 
    
    Audubon Youth Development Center                        $ 1,000.00

    Goldsmith Elementary School                                  $ 1,232.75

V.N.5. Acceptance of Grant from the Kentucky Arts Council
Rationale

The Kentucky Arts Council (KAC) has awarded the district a $1,600 grant to be used by Ballard High School to pay artists’ fees for the Poetry Out Loud program.

The funds will be used to bring eligible artists into the school to help prepare students for the state competition and to pay the transportation cost to take the school’s champion to Frankfort for the finals. 

Recommended Motion

Superintendent Sheldon Berman recommends that the Board of Education accept a grant totaling $1,600 from the Kentucky Arts Council (KAC).

V.N.6. Acceptance of Grant from the NASPE/ING Run For Something Better Grant
Rationale

The National Association for Sports and Physical Education (NASPE)/ING has awarded a $2,000 grant to the district to be used by the Gutermuth Elementary School Family Resource Center for an after-school running program for fourth- and fifth-grade students.

This grant is to be used to provide registration fees for various races, including the Louisville Triple Crown of Running program and the Kentucky Derby Festival Mini Marathon. The students will receive running shoes and uniforms for competitions and will be provided an opportunity to participate in a culminating activity at the annual NASPE conference in Indianapolis, Indiana. 

Recommended Motion

V.O. Approval of Memorandum of Agreement with the Education Professional Standards Board
Rationale

The Kentucky General Assembly, via KRS 161.131, established the goal that by the year 2020 there will be at least one National Board for Professional Teaching Standards (NBPTS) certified teacher in every public school in Kentucky.

Additionally, KRS 161.133 established the Teachers' National Certification Incentive Trust Fund that provides NBPTS certified teachers to serve as mentors to NBPTS candidates. Board of Education action is necessitated by KRS 160.290.

Recommended Motion

Superintendent Sheldon Berman recommends that the Board of Education approve the Memorandum of Agreement with the Education Professional Standards Board for year 2010-11 and authorize the superintendent to sign the same.

V.P. Approval of Memorandum of Agreement for VuPal Network, LLC
Rationale

Doss High School will participate in a pilot program with VuPal, who will provide software that permits recording of video sessions for a peer-to-peer skills development pilot program for teachers. The video sessions will be focused intra-school with Doss High School participating in the pilot program. The pilot program will include a total of ten (10) video sessions. The contract amount shall be paid from Doss High School’s general fund.

Doss High School will have access to a dedicated portal and operational version of the VuPal software, and each participating teacher will have an individual log-in. The pilot program will be for a total of ninety (90) days. The school will have access to the VuPal system during the pilot program and after the conclusion of the pilot program until the last working day for teachers at the conclusion of the 2009–10 school year.

V.Q. Approval of Contract with September Films Limited
Rationale

The Teenage Parent Program (TAPP) will participate in a filming of day-to-day activities of staff and students for the purpose of the production of a one-hour prime time television special that will focus on students, parents, and staff and how they work together during pregnancy and the transition to motherhood.

The $10,000 remuneration fee will be used for programs to enhance student learning and staff support.

V.R. Approval of Third-Party Release of Material to George Lucas Educational Foundation
Rationale

The George Lucas Educational Foundation is requesting to use materials developed by Jefferson County Public Schools for our CARE for Kids program. These materials will be used on their website, Edutopia, to showcase and support our CARE for Kids program as what works in public schools.

Recommended Motion

Superintendent Sheldon Berman recommends that the Board of Education approve the release of material to the George Lucas Educational Foundation and authorize the superintendent to sign the attached agreement.

VI.A. Approval of the General Fund Draft Budget for Fiscal Year 2010-11
Rationale

The General Fund Draft Budget is preliminary due to the following:

  1. The central office cost center budgets for fiscal year 2010-11 are still in the process of being reviewed and will be completed in March 2010.
  2. Projected student enrollment numbers by school are used to determine the individual school allocations.
After the Board of Education approves the enrollment projections, individual school allocations will be determined. Enrollment projections will be presented to the board for approval in February 2010.

Individual site-based allocations are due to schools no later than February 8, 2010. The General Fund Tentative Budget will be presented to the Board in May 2010 as required by KRS 160.470.

VI.B. Acceptance of the Nutrition Services and Physical Activity Report
Rationale

Senate Bill 172, an act relating to health and nutrition in schools that was adopted by the 2005 Kentucky State Legislature, requires that the district’s Director of Nutrition Services prepare a report to assess the district’s School and Community Nutrition Services program. According to KRS 158.856(6), the report shall include:

  1. An evaluation of compliance with the National School Breakfast and National School Lunch programs.
  2. An evaluation of the availability of contracted fast foods or foods sold through commercial vendors.
  3. A review of access to foods and beverages sold outside the National School Breakfast and National School Lunch programs, including vending machines, school stores, canteens and a la carte cafeteria sales.
  4. A list of foods and beverages available to students, including the nutritional value of those foods and beverages.
  5. Recommendations for improving the school nutrition environment.
The report to the Board of Education shall also include an assessment of the physical activity environment. The attachments and presentation by staff will provide the board with the Nutrition and Physical Activity report that is being made available to the public via the district website.

After the board receives and adopts the report, the district will present the report to all SBDM councils. The superintendent will submit a summary of the Nutrition and Physical Activity reports and recommendations to the Kentucky Department of Education by May 1, 2010.

Rationale

The District Calendar Committee composed of representatives from employee unions, Central Office departments, the PTA, Board District parent representatives, and local schools developed the attached calendars.

The calendars include 187 scheduled days plus two parent-teacher conference days for teachers and 175 days (1074 instructional hours) for students. Teachers will have one day prior to the start date to set up their classrooms.

Included within the calendar are the following:

  • 1074 Student Instruction Hours
  • 1 Opening Day
  • 4 Paid Holidays
  • 4 Professional Development Days (3 flexible)
  • 2 Nonflexible Professional Development Days
  • 2 Parent-Teacher Conference Days

Any accrued instructional time in district calendars over the Kentucky Department of Education's minimum is to be designated as 'banked' instructional time. 

All 260-day employees have nine paid holidays. A list of the recommended paid holidays for the 2010-11 and 2011-12 school years is attached.
