Rationale

In light of the Governor having declared a state of emergency within the Commonwealth on March 6, 2020, as a result of the COVID-19 outbreak and in compliance with guidance issued by the Executive Branch on March 12 and 16, 2020, regarding the conduct of meetings of state boards and commissions during the emergency period, this meeting will be conducted by video-teleconference and available for live public viewing at the following link: JCBE MEETING VIDEO

Members of the public will have the opportunity to voice opinions or express concerns by submitting remarks via email. Remarks should be limited to 500 words or less and sent to the Assistant Secretary to the Board (angela.gilpin@jefferson.kyschools.us) for dissemination purposes prior to the meeting. Public remarks will be shared with each Board member and recorded in the Official Minutes.

VI.A. Recommendation for Approval of a Revised 2020-2021 Calendar and the Opening of School Plan
Rationale

Revised 2020-21 Calendar

The JCPS Calendar Committee met on Wednesday, July 1, 2020, at 3:00 p.m. to discuss possible options that would allow more preparation time for the return of students for the coming academic year. The Committee's proposal is to start 187-day instructional staff on Monday, August 10th and have students return on Tuesday, August 25th. Maintain October 2nd as a non-school day.

This proposal:

  • Makes 10/6, 11/2, 1/4, and 3/26 instructional days. 
  • Makes the first day for 187 instructional staff 8/10 and students 8/25.
  • Maintains 187 days for instructional/school staff. 
  • Allows for 11 days preparation/training before students return to school on August 25, 2020, two of which would be flexible PD days, as required. 
  • Makes the last day for students May 27, 2021, with the last day for instructional/school staff on May 28, 2021. 

The calendar committee did not discuss which days would be flexible and non-flexible professional development or in-service. After conversations and agreement with union leaders the attached calendar sets

  • 8/11, 8/17, 8/18, 8/19, 8/20 and 8/24 as non-flex in-service
  • 8/12 and 8/13 as Professional Development Gold Days
  • 8/14 and 8/21 as Professional Development Flex Days

The Board may accept the proposal as is or adjust it. 

Employee work calendars will be adjusted accordingly to fulfill contract day requirements, and employees and families will be notified in accordance with standard practice.

Opening of School Plan the 2020-2021 School Year

As the new school year approaches, the ongoing COVID-19 pandemic presents unprecedented challenges for the District to fulfill its mission to “challenge and engage each learner to grow through effective teaching and meaningful experiences within caring, supportive environments,” while at the same time keeping an unwavering priority on the health and well-being of students, families, and employees.

Over the last several months, a District Pandemic Response Team, composed of administrators, teachers, and others has been meeting, talking to health experts, sharing ideas with other school districts, and monitoring the guidance from state and federal education and health officials. It has also worked to gather input from teachers, classified staff, administrators, parents, and community members.

The work of the Pandemic Response Team builds upon the successful planning and implementation of Non-Traditional Instruction (NTI) for the end of the 2019-2020 school year, and the expanded online summer 2020 learning opportunities. The team is using the lessons learned from building and implementing an entirely new learning model, with high student participation, as a key component of plans for the fall.

Scope and scale of the challenges to reopening school in the midst of a global pandemic, however, are profoundly daunting. Easy answers are hard to come by. Over the course of months of work, what the team discovered is the same thing every school district in America has discovered - there are no good options for returning to school this fall, only imperfect ones.

To frame this difficult work, the Pandemic Response Team identified a set of core concepts to be taken into consideration as plans are developed:

  • Health & Safety of students, employees, families & community.
  • High-Quality Instruction across all platforms.
  • Flexibility to adapt to new public health circumstances quickly and effectively.
  • Equity to foster an environment of emotional health, with a focus on ending practices that negatively impact Black and Brown students.
  • Accurate and Timely Communication to students, families, and employees.
  • Community Trust built through actions that rely on expert guidance and take into account the needs and perspectives of all stakeholders.

The plan being presented represents what the Superintendent and District leadership believe are the best models to implement for the benefit of students, families, teachers, school support staff, and others employee groups.

In the broadest terms, the JCPS plan for the 2020-2021 school year has only a few main components:

  1. Begin the school year with District-wide implementation of the NTI at-home learning model, with more synchronous, robust, and engaging instructional components, and greater supports for students and families.

     2. a. Make preparations for the return to in-person school, as soon as data and public health guidance permit the District to do so safely.

         b. When school buildings reopen, provide a full-time online Virtual class option for those families who do not wish to return to in-person classes.

     3. Every six weeks, the Superintendent will assess all available information, data, and public health guidance, and make a determination whether to continue NTI, or move to the in-person and virtual class options.

In these challenging times, the job of district leadership is to make clear and actionable decisions based on the imperfect information and options available, communicate them to all constituencies effectively, and ensure high-quality implementation. Planning must be detailed and comprehensive. At the same time, the District must develop robust contingency plans, and be prepared to respond quickly and alter plans, perhaps dramatically, if new information and guidance from health and science experts require it.

As District leadership, administrators, teachers, classified staff, students, families, and the community enter together into this uncharted territory, the importance of working together in common purpose, and supporting one another through difficult times has never been more important. Together, with patience and understanding for one another, great planning, and hard work, JCPS can become a model for school districts across the nation.

The Kentucky Department of Education, Division of Facilities Management, reviewed the Application for a Building Project, plans and specifications, and approved the taking of bids.

Bids were received, publicly opened, and read aloud in the Office of Facility Planning on June 18, 2020. The bid tabulation is attached.

This item requests approval to award contracts to the low bidders of facility construction projects and reject bids deemed unacceptable in accordance with KRS 162.070.

Rationale

The Kentucky Department of Education has awarded the District $20,000 to be used to supplement the salary of a coordinator to administer comprehensive county-wide community education programs to expand the utilization of schools for all members of the community. There is a $5,000 (25%) match supplied by JCPS Adult and Continuing Education.

The Community Education program will support schools in reducing the drop-out rate, decreasing the number of students who are retained, increase student attendance and provide preparation and planning for life after public school. The program is operated through JCPS Adult and Continuing Education. The funds will be used to cover staff salaries, fringe benefits and expenditures. JCPS Adult & Continuing Education is responsible for the 25% match or $5,000. There is no other indirect cost to the district. The term of the contract is July 15, 2020 through June 30, 2021.

VII.O.3. Acceptance of IDEA-B State Share Restricted Funds from Kentucky Department of Education
Rationale

Funds are awarded based on proposed scope of work for the Special Education Cooperatives throughout the state. The Kentucky Department of Education has identified nine special education cooperatives around the state to provide training and technical assistance to districts throughout the state. The Greater Louisville Education Cooperative (GLEC) includes Jefferson County Public Schools and the Kentucky School for the Blind as its member districts. JCPS serves as fiscal manager for GLEC.

KDE has outlined priorities for use of funds. Funds will be used to provide training and technical assistance in core content instruction; specially designed instruction, differentiated instruction and technology-based supports; and evidence-based practices to improve behavior and academic achievement.

Funds will also pay for supplies, materials, consultants, and professional development stipends.

This funding directly supports strategy 2.2.3 of Vision 2020.

  • Collaborating with business, labor, and industry partners to provide experiential learning opportunities aligned with community needs and student interests; and
  • Collaborating with community and postsecondary partners to enable students to earn credentialed diplomas featuring industry certificates and college credit.

Career and Technical Education funding does not require a cost share or match does not obligate the District financially.

Rationale

The University of Louisville College of Education and Human Development received a grant from the National Writing Project (NWP). The NWP is a network of sites anchored at colleges and universities and serving teachers across disciplines and at all levels, early childhood through university. NWP provides professional development, resources, and generates research to improve the teaching of writing.

This amendment pays for the salary, extended service time, and fringe benefits of Ms. Suzanne Jackson, an English Language Arts teacher at Moore High School through September 30, 2020. She will spend 100% of her time this school year planning and facilitating professional development with the Kentucky Writing Project. Ms. Jackson will remain an employee of the district and shall be under the district’s supervision.

The original subaward agreement was approved by the Board on August 16, 2019.

This funding directly aligns with strategy 2.1.2 in Vision 2020.

VII.P.1. Recommendation for Approval of Memorandum of Agreement with Campbellsville University for Dual Credit
Rationale

Dual Credit personnel from Campbellsville University have worked with the high school staff to identify teachers with the necessary credentials to offer dual credit for students scheduled in those courses. This agreement also allows students to take qualifying college courses on Campbellsville’s Louisville campus or online for dual credit if courses or faculty are not available at the school level. The agreement aligns with the Dual Credit Scholarship Program. These dual credit courses can be transferred to any regionally accredited college or university for credit. Campbellsville University is a Partner Post-secondary Institution with KHEAA for that program.

Specifically:

  • Scholarship funds may be used for dual credit unless the student has exceeded 2 courses or state funds are exhausted. In that case, the student/family is responsible for paying tuition.
  • Tuition is set to 2/5 KCTCS tuition (as required by the PPI agreement with the KHEAA). Campbellsville will not charge JCPS for reimbursement of unsuccessful student tuition.

This project supports Vision 2020 Strategies 1.1.3 - Provide equitable access and 1.1.7 - Eliminate opportunity gaps

VII.P.2. Recommendation for Approval of the Memorandum of Understanding with Kentucky Higher Education Assistance Authority and Kentucky Campus Compact on Behalf of Valley and Southern High Schools
Rationale

Kentucky Higher Assistance Authority (KHEAA) administers various student financial aid programs and conducts myriad outreach activities in order to help improve access to higher education for Kentucky students and their families.

Kentucky Campus Compact (KYCC) is a statewide coalition of college and university presidents that promotes public and community service that develops citizenship skills, helps campuses forge effective community partnerships, and provides resources and training to integrate civic and community-based learning into the curriculum.

KHEAA will place a fully-trained AmeriCorps College Coach in Valley and Southern High Schools to serve as a full-time near-peer mentor for students.

KHEAA will provide regular, rotating oversight for AmeriCorps members to ensure they are engaged in service activities to help high school students and their parents develop higher education aspirations, understand their options for postsecondary education, and learn about/utilize the resources available to help pay for education beyond high school.

This supports Vision 2020 Focus Area and Goal of Learning, Growth and Development

VII.P.3. Recommendation for Approval of Data Sharing Agreement with Learning A-Z
Rationale

Learning A-Z will provide software licenses for Reading A-Z, Raz-Kids, Science A-Z, Writing A-Z and Vocabulary A-Z to various schools that focus on online educational resources.

The purpose of this agreement is to delineate the operational guidelines for sharing data between Learning A-Z and JCPS and define the respective roles and responsibilities of each party. Data sharing will begin upon acceptance of this agreement. All procedures and processes will be FERPA compliant. Period, scope, and protections are also outlined in the attached agreement. There is no cost to the District for the data sharing agreement. This supports Vision 2020 strategy 3.1.1- Improve physical infrastructure.

VII.P.4. Recommendation for Approval of Service Agreement with UofL Health - Louisville, Inc dba Frazier Rehabilitation Institute
Rationale

University of Louisville Health-Louisville, Inc dba Frazier Rehabilitation Institute (Frazier) will provide certified athletic trainers to Doss and DuPont Manual High Schools to assist the schools in developing and maintaining an athletic training program designed to reduce athletic injuries and promote the safe and prompt rehabilitation of students after athletic injuries.

Frazier will provide a trainer to attend all home football, soccer, field hockey, basketball, baseball and track, softball, and track and field events unless otherwise agreed by both Parties.  A trainer will be at each participating school for an average of fifteen (15) hours per week for program implementation and/or game coverage.

JCPS agrees to purchase all athletic training supplies to be used by the trainer. JCPS agrees to provide an athletic training room for the trainers. JCPS agrees to allow advertisement in the stadium and/or gymnasium at each participating school as well as Public Address (PA) announcements during any home events where the PA system is utilized.

This agreement will be effective starting July 22, 2020, and end on June 30, 2022.

Rationale

University of Louisville/Belknap Campus will continue to provide Jefferson County Public Schools (JCPS) with office space and will house a Jefferson County High School site. Office space shall include utilities, security, janitorial service, phone service, and internet connectivity. It will also include offices, classroom space, and classroom technology.

The total cost for the leasing agreement is $82,695.60 per year.

This amended agreement will be effective starting September 1, 2020, and will continue through August 31, 2021.

This project directly supports Vision 2020 strategy 3.1.1 Improve physical infrastructure.

VII.P.6. Recommendation for Approval of Teacher Retention Agreement with Teach Upbeat
Rationale

Teach Upbeat will help us develop a better understanding of school climate factors that lead JCPS non-tenured teachers to exit early the profession or senior teachers to seek early retirement. This will help us address these factors and improve teacher retention in our low-teacher retention schools. This project follows the continuous improvement approach. The improvement cycle has five phases: survey, (data) analysis, dialogue (with school-based stakeholders), support (through coaching), and action (planning and implementation). This improvement cycle is to be implemented twice during the school year and it is based on teacher retention data so that coaching can be targeted toward specific areas of growth.

The contractor shall provide services associated with teacher retention using improvement cycles based on data and coaching. The need of working on teacher retention in schools is always important, but more critically important in the context of the pandemic.

The District’s total cost is $30,000.00

VII.Q. Recommendation for Approval of Contracts for Nonresident Pupils for Fiscal Year 2020-21
Rationale

702 KAR 7:125 requires (1)(a) A written agreement executed by local boards of education for enrollment of nonresident pupils as provided by KRS 157.350(4)(a) shall be filed in both the attending district and the resident district no later than February 1 of the year prior to the school year to which it will apply. (b) The written agreement shall include the specific terms to which the districts have agreed. (c) A list of the names of all nonresident pupils enrolled in the attending district covered by the agreement shall be filed in both the attending district and the resident district not later than November 1 of the school year covered by the agreement.

Although we submitted all contracts that we had received according to February 1 deadline, we cannot control the actions of other school districts or their Boards. The attached reciprocal non-resident contracts were just received from Hardin County and they are submitted for approval.

Rationale

Board policies 09.428 Student Rights and 09.438 Student Support and Behavior Intervention Handbook and KRS 158.148 establish a process and timeline for the review of the Code of Acceptable Behavior and Discipline and The Student Bill of Rights (Code). 

The Student Support and Behavior Intervention Handbook has been updated to reflect changes in JCPS Board Policy, Kentucky Revised Statute, KSBA Policy, and Kentucky Statute. Outside these aforementioned changes, content for the 2020-21 Student Support and Behavior Intervention Handbook remains mostly unchanged.  Slight changes were made to existing content to emphasize or clarify key points.  Additional changes occurred as a result of the REAP process. The draft Student Support and Behavior Intervention Handbook is attached for Board approval for implementation during the 2020-21 school year.

Rationale

The proposed revised policies were received by the Board of Education for First Reading on June 23, 2020.

Each year, the Kentucky School Boards Association (KSBA) provides local boards of education with a Board Policy Update, which provides recommended amendments to board policies based on changes from the preceding year to state and federal statutes and administrative regulations.

The attached document shows proposed amendments to Board policies from the KSBA 2020 Board Policy Update, incorporating suggested language from the Board Policy Committee, District staff, and the General Counsel.  Proposed new language is underlined, and proposed deletions are shown using strikethroughs.

KRS 160.340 requires board policies be kept up to date with annual amendments by August 15.

VII.U. Adoption of Board Policy 05.51 Information Security and Privacy Program (First Reading)
Rationale

The Information Technology Division and Internal Audit Department have led a process to develop a District Information Security and Privacy Program, which included a team of staff from across divisions, and which revised guidance from external experts.

The purpose of this policy is to establish a comprehensive framework for the management of risk relating to information security and privacy, which will be accomplished through the development and implementation of a series of procedures relating to areas identified in the policy. Many of the practices included in the policy and the forthcoming procedures are already in place; this policy and related procedures will provide a unified and coherent codification of information security and privacy practices.

The District Information Security and Privacy Program is based on the National Institute of Standards & Technology (NIST) Cybersecurity Framework of the National Institute of Standards & Technology of the U.S. Department of Commerce, and represents a leading information security management system.

VII.X. Recommendation for Approval to Request a Finding to Add a New Middle School in the West End to the District Facility Plan
Rationale

The change will not substantially affect the District’s needs assessment, and it will only affect one facility.

Do to anticipated changes to the Jefferson County Public School’s Student Assignment Plan, a new middle school will need to be constructed in the West End to account for students choosing a school closer to their resides area. This new school must first be included in the District Facility Plan in order to proceed.

Upon approval, the Board will reconvene the Local Planning Committee and apprise the members of the need for the finding.
