VI. Workers Comp Policy

Motion Passed:  Approved Workers Comp Policy Employee’s pay to be calculated as follows: Hourly wage x normal scheduled hours per week x 66.66% (this is the rate Worker’s Comp will pay). Payment will not include any wage taxes or benefits such as F.I.C.A., Retirement, County, Federal or State taxes. Payment will be issued through the Treasurer’s office. Any Health Insurance related deductions shall be the responsibility of the employee and shall be paid when a statement is presented. Note: When an employee is off work for 2 weeks and the county pays that employee through payroll before his/her workers comp begins the employees pay plus taxes and retirement that are matched exceeds the amount of the workers comp payment. This would require the employee to ‘pay back’ more than his workers comp check that is received after the 2 week period. passed with a motion by Larry Keown and a second by Joe Barnes.

Motion Passed:  Approved Resolution 2016-2 Pension Spiking Payments WHEREAS, the Commonwealth of Kentucky recently addressed concerns with pension funding by enacting various statutes addressing the concern of pension spiking; and WHEREAS, the various governmental departments of Ohio County are aware that for each employee retiring after January 1, 2014, that began participating in retirement benefits programs prior to January 1, 2014, the Kentucky Retirement Systems will determine if a spike in annual compensation of greater than 10% occurred over the prior year for each of the employee's last five fiscal years of employment; and WHEREAS, the Ohio Fiscal Court government will be responsible to the Commonwealth of Kentucky if the Kentucky Retirement Systems believes there has been a spike in annual compensation as noted above; and WHEREAS, the Ohio Fiscal Court is unable to anticipate or budget for the potential spike retirements payments as the various governmental departments of the Ohio Fiscal Court control certain aspects that could cause compensation spiking; and WHEREAS, to minimize the risk associated with this unknown cost, the Ohio Fiscal Court believes it to be in the best interest of all governmental departments that any payments required to the Commonwealth of Kentucky as a result of pension spiking be assessed against the department to which this employee retired from. NOW THEREFORE, BE IT RESOLVED that any billings or payments due to the Kentucky Retirement Systems as a result of any assessed retirement/compensation spiking determination shall be paid by the department for which the employee worked. passed with a motion by Larry Morphew and a second by Joe Barnes.

Motion Passed:  Approved the appointment of Mary Pat Donlon to the Ohio County Public Library Board of Trustees passed with a motion by David Johnston.

Motion Passed:  Approved OCEDA part time new hire Sarah Coots as Administrative Assistant at the rate of $15.00 per hour on contract basis effective July 29, 2015 passed with a motion by Jason Bullock and a second by Sam Small.
