New Regulation 704 KAR 7:160 legal change – defines and outlines the use of physical restraint and seclusion. (to be in place by May 1st)
Procedure 09.2212 AP.21 – Physical Restraint and Seclusion Forms
New forms to meet requirements of 704 KAR 7:160 that says the district must establish new policy and procedures outlining documentation of physical restraint and seclusion.
Procedure 09.14 AP.232 - Release of Records to State Child Welfare Agency
This form has been completely redesigned and renamed to address release of student records information to representatives of an authorized state child welfare agency. The current form that it may replace is not needed because parents are notified in the annual FERPA notice that the District is not required to notify them when student record information is transferred to a school, school system or institution of postsecondary education where the student enrolls or seeks to enroll.
Although this form is not required by law, KSBA recommends the Board accept it since a new federal law authorizes such release to child welfare agencies in order to facilitate continuity of services for children placed under the protection of welfare agencies.
