11. Your Duty Under the Law, Managing Government Records, & Certificate of Distribution
Discussion

Pursuant to KRS 160.395(1), superintendents of public school districts must distribute “Your Duty Under the Law” and “Managing Government Records” to each elected school board member and each school-based decision making council member, as designated in KRS 160.345(2), within their respective districts.  Superintendents must distribute the written information to current board and council members within sixty days of receipt of the newly revised information from the Attorney General, and to newly elected or appointed board and council members within sixty days of their election or appointment.  The information may be distributed by electronic means.


Pursuant to KRS 160.395(2), superintendents must obtain signed proof from each school board member and school council member that he or she received “Your Duty Under the Law” and “Managing Government Records.” Superintendents must also certify to the Office of the Attorney General that the written information has been distributed as required. A “Certificate of Distribution” is also attached and will be submitted as required.

The District Facility Plan (DFP) is revisited at least every four years to address significant projects that need to take place.  A twenty-member local planning committee is formed to develop the DFP which is then presented to the Board for consideration.

This request will allow us to repurpose the existing band/music room to become the main entrance for visitors and to become the main office space for the school. The construction criteria of 702 KAR 4:170 is based off of a minimum school enrollment of 500 students; we have 328 students; 25 enrolled in band and 12 in choir.


This waiver would allow band/music classes to be held in a room that does not meet some of the requirements of 702 KAR 4:170.  The tentative plans to construct a new band/music room have been included in the most recent District Facilities Plan (however, funding is prohibitive). The approval of this waiver would allow us to expedite this safety feature.


This proposal was developed in consultation with local law enforcement to enhance the security of our high school.  The current and proposed entrances, commons area, and office spaces are noted in the attached document.  


The submission of this waiver does not mean that a final decision has been made to move forward with this task.

This is an update to a prior agreement.  Crittenden County approved a pay increase after the first MOU was approved.  This MOU reflects the increase in the daily pay rate.

Speech-Language Pathologists (SLPs) where once required to hold a "teacher" certification from the EPSB.  Recent changes now allow school districts to employ licensed SLPs even if they do not have the actual teacher certification.  The SLPs do not "teach" classes, but they do provide SLP services to our students, meaning, a licensed SLP is just as qualified as a certified SLP when it comes to servicing our students' SLP needs.


The Livingston County, Kentucky Board of Education currently has a position for a Certified SLP but there is not a position for a Classified SLP with a corresponding salary schedule.  There were not any SLP applicants who held a current teacher endorsement for SLP, but there were applicants who would qualify as a classified SLP. 


The approval of this contract ratifies the decision to create a classified SLP position with the corresponding salary schedule.
